WINDSOR, N.S. — A Windsor man whose case has been before the courts since October 2014 will have to wait a little longer for it to wrap up.
Following a lengthy trial, Judge Alan Tufts found Garnett Frederick Smith guilty of sexual interference, invitation to sexual touching, exposing his genital organs and sexual assault of a minor. Smith was due to be sentenced in April 2017, but Smith’s lawyer, Tim Peacock, indicated in March 2017 that his client would be seeking to challenge the constitutionality of mandatory minimum sentences.
Smith’s matter was due back in court on Oct. 30 but court records indicate Smith is to return in the new year for a decision on a constitutional challenge.
Smith, who had operated a skate-sharpening kiosk at the Hants Exhibition Arena around the time of the incidents, is scheduled to return to court on Jan. 19, 2018.
Smith remains out of jail while adhering to release conditions.
