House arrest for theft, mask, interference

An Annapolis County man will be under house arrest for a number of offenses he committed during an incident in Kentville March 31.

Lequille resident Keith Anthony Scott Daniels, 21, pleaded guilty in Kentville provincial court June 12 to being masked while attempting to commit an indictable offense and interfering with lawful enjoyment of property. He had already pleaded guilty April 14 to theft and failing to comply with a probation order.

Judge Claudine MacDonald imposed a three-month conditional sentence order (CSO) on Daniels, the first two months to be served under house arrest. The remainder will be in the form of a curfew. The house arrest has the usual exceptions for employment, education, appointments and emergencies.

The CSO is also to be followed by a one-year reporting probation, conditions of which include Daniels taking any recommended assessment, counselling or treatment and refraining from possession of consumption of alcoholic beverages or non-medically prescribed drugs.

Jailed for fraud, breach

Hantsport resident David Andrew Corey Zwicker, 19, pleaded guilty June 12 to using a forged document as genuine and to failing to comply with a probation order.

Judge MacDonald sentenced Zwicker to 45 days in custody each for the convictions, to be served concurrently. The sentences were a joint recommendation by the prosecution and defense counsel.

Zwicker committed the fraud and breach in New Minas June 11.

CSO, probation for theft, breach, failures to attend

Halifax resident Frank James Chambers, 31, pleaded guilty June 12 to theft, failing to comply with a probation order and two counts of failing to attend court as ordered.

Judge MacDonald imposed a six-month conditional sentence order, followed by six months’ reporting probation. The CSO is in the form of a curfew.

Chambers committed the theft and probation breach at a Greenwood store Feb. 27, 2007; the first failure to attend in Kentville, April 10, 2007; and the second failure April 7, 2008.

Possessed marijuana by indictment

Judge MacDonald suspended sentencing on Canning resident Raymond Patrick Curran, 45, June 10 on convictions of possession of marijuana, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA), by indictment and imposed a term of 15 months’ reporting probation on him. Probationary conditions include Curran taking any recommended assessment, counselling or treatment, and refraining from possessing or consuming alcoholic beverages or non-medically prescribed drugs.

Judge MacDonald also fined Curran $200 plus a $30 victim surcharge, or three days’ custody on willful default, for storing a rifle in a careless manner.

She also forfeited materials involved in the two offenses.

Curran committed the offenses in Canning Sept. 18, 2007 and pleaded guilty to the charges April 15.

Probation, fine for possession

Judge MacDonald imposed a term of one-year reporting probation June 10 on Canning resident Robert Martin Curran, 43, and fined him $500 plus a $75 victim surcharge, or eight days in custody on willful default, for possession of cannabis marijuana by indictment, contrary to the CDSA.

The judge also forfeited materials involved in commission of the crime.

Curran committee the offense in Canning Sept. 18 and pleaded guilty to the charge April 15.

Probation for theft, failing to attend

Judge MacDonald suspended sentencing June 10 on Waterville resident Kevin Elwood Pelton, 20, for theft and failing to attend court as ordered and imposed a term of eight months’ reporting probation on him.

Probation conditions include Pelton taking any recommended assessment, counselling or treatment; paying $50 in restitution and refraining from possessing or consuming alcoholic beverages or non-medically prescribed drugs.

Pelton committed the theft in Waterville Dec. 3, when he stole tools valued at less than $5,000. He failed to attend court as ordered Feb. 25. He pleaded guilty to the charges April 14.

Breached probation

Kentville resident Leonard Gordon Schofield, 24, pleaded guilty June 12 to failing to comply with a probation condition.

Judge MacDonald fined Schofield $200 plus a $30 victim surcharge, or three days in custody on willful default.

Schofield committed the breach in Kentville between Jan. 4 and March 21, 2007, when he failed to be under supervision.

Convicted automatically

Judge Alan Tufts automatically convicted Halifax resident Derek Thomas MacPhee, 27, June 11 of driving between one and 16 kilometres in excess of the posted speed limit, contrary to the Nova Scotia Motor Vehicles Act (MVA).

The judge fined MacPhee $100 plus a $15 victim surcharge and $107 costs. Police laid the charge in Wolfville Oct. 6, 2007.

MacPhee successfully had a previous automatic conviction on the matter struck Dec. 20. He pleaded not guilty that day and received an order to attend court for trial June 11.

Judge Tufts automatically convicted North Alton resident Kyle Anthony Zwicker, 20, of illegal possession of liquor, contrary to the Nova Scotia Liquor Control Act (LCA), and fined him $300 plus a $45 victim surcharge and $107 costs. Police laid the charge in Berwick Oct. 6, 2007.

Zwicker had a previous automatic conviction on the charge struck Dec. 17. He pleaded not guilty to the charge and was scheduled to appear in court June 11 for trial. He failed to attend.

June10, Judge Tufts automatically convicted Wolfville resident Bradley Daniel Wilkinson, 23, of illegal possession of liquor, contrary to the LCA; and fined him $300 plus a $45 victim surcharge and $107 costs.

Wilkinson had pleaded not guilty to the charge Dec. 17, but he failed to attend court for his June 11 trial.

Fined for breathalyzer

Aylesford resident Travis Darrell Seyforth, 20, pleaded guilty June 5 to driving while his blood/alcohol readings exceeded the 80 mg/100 ml limit.

Judge Tufts fined Seyforth $850 plus a $127.50 victim surcharge, or 15 days in custody on willful default, and prohibited him from driving in Canada for a year. The Registry of Motor Vehicles will ban Seyforth from driving in the province for at least a year.

Judge Tufts allowed provisions to provide for Seyforth’s vehicle to be fitted with an ignition interlocking device after the first three months of the prohibition.

Seyforth committed the offense in Greenwood March 9 when police found he had readings of 170 and 160 mg/ 100 ml.

Breached probation

Lakeville resident Michael Patrick Mosher, 18, pleaded guilty June 11 to failing to comply with a probation order.

Judge MacDonald fined Mosher $150 plus a $22.50 victim surcharge, or two days in custody on willful default.

Mosher committed the breach in Kentville earlier June 11.

Stole from store

North Kentville resident Anita Margaret Blanchard, 55, pleaded guilty June 9 to theft of property valued at less than $5,000 from a Kentville business.

Judge MacDonald fined Blanchard $50 plus a $7.50 victim surcharge. Blanchard committed the theft in Kentville May 8.

Possessed marijuana

Pereau resident Anthony William Pineo, 46, pleaded guilty June 9 to possession of less than 30 grams of cannabis marijuana, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA).

Judge MacDonald fined Pineo $200 plus a $30 victim surcharge, or three days in custody on willful default. Pineo committed the possession in New Minas April 18.
