Exceeded legal limit

The court has fined a Windsor man for driving while his breathalyzer readings were above the permitted level.

Jeffrey Wayne Leighton, 30, pleaded guilty in Windsor provincial court Tuesday, April 29 to operating a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded the legal limit.

Judge Alan Tufts fined Leighton $1,000 plus a $150 victim surcharge and gave him until Jan. 29, 2009 to pay -- or spend 17 days in custody on willful default.

As well, the judge imposed a two-year, Canada-wide driving prohibition order against the accused, a ban the Nova Scotia Registry of Motor Vehicles will at least match.

Leighton committed the offence in Falmouth March 30, 2008, when police found that he had blood-alcohol readings of 130 and 130 milligrams of alcohol per 100 millilitres of blood. The legal limit is 80 mg/100 ml.



Refused breathalyzer

The court has fined Louis Paul Roberts, 56, for failing without reasonable excuse to comply with a demand made to him by a peace officer to provide a sample of his breath for blood-alcohol analysis.

Roberts entered a guilty plea to the charge in Windsor provincial court Friday, May 2.

Judge Tufts fined $950 plus a victim surcharge of 127.50 and gave him until Aug. 30 to pay or spend 15 days in custody on willful default.

The judge also imposed a one-year, Canada-wide driving prohibition against Roberts, a ban the Nova Scotia Registry of Motor Vehicles will at least match.

Roberts committed the offence in Hants County March 29.



In other court matters

Judge Tufts fined Halifax resident Mary Anne Fleming, 23, for driving at a speed exceeding the posted limit, contrary to the Nova Scotia Motor Vehicles Act (MVA).

Fleming entered a guilty plea to the charge April 29, and the matter was adjourned to May 2 in order for the court to hear an application for remission of penalty.

Judge Tufts denied the application for remission of penalty May 2 and fined Fleming a total of $279.50. He gave Fleming until Sept. 30 to pay with no default.

The judge also imposed a one-week drivers’ license suspension against Fleming, to be served between noon May 21 and 28.

Fleming committed the offence near Highway 101 Exit 3 in Hants County Feb. 28, 2008, when she was found to be driving in excess of the posted speed limit by between 16 to 30 kilometres per hour, inclusive.

Convicted automatically

The court has fined Jesse Aldon Turner, 25, Halifax, for being intoxicated in a public place, contrary to the Nova Scotia Liquor Control Act (LCA).

Turner was not present as scheduled for court in Windsor April 29, and Judge Alan

Tufts entered an automatic conviction against him.

Turner received a total fine of $111.50 and was given until June 24, 2008 to pay with no default.

Police laid the charge in Windsor April 6, 2008.
