CSO for assault, mischief

The court has imposed a conditional sentence order (CSO) followed by probation on a Windsor man for an assault causing bodily harm and for committing mischief.

Diamek Darren James Walker, 22, pleaded guilty in Windsor court Monday, April 7, to assault causing bodily harm by indictment, and to committing mischief by willfully damaging property.

Judge Claudine MacDonald imposed a three-month CSO, all of which will be served under curfew, to be followed by one year probation.

The CSO and probation conditions include Walker taking any recommended assessment, counselling or treatment and having no contact with a specific person.

The judge also prohibited Walker from possessing firearms or ammunition for 10 years and three months, with a lifetime ban on restricted weapons.

Walker committed the assault at Saint Croix June 16-17, 2007, and the mischief in Windsor June 17.

Fined for breathalyzer offense

Windsor Forks resident Kevin Francis Bridges, 23, pleaded guilty April 8 to driving while his blood-alcohol level exceeded the legal limit.

Judge MacDonald fined Bridges $900 plus a $135 victim surcharge, or 17 days in custody on willful default, and prohibited him from driving in Canada for a year.

The Nova Scotia Registry of Motor Vehicles will ban Bridges from driving in the province for at least a year.

Bridges committed the offense in Saint Croix Jan. 18, when police found that he had blood-alcohol readings of 150 and 150 milligrams of alcohol per 100 millilitres of blood.

The legal limit is 80 mg/100 ml.

Probation for assaults, mischief

In court April 7, Judge MacDonald suspended sentencing on Windsor resident John Thomas Victor Smith, 29, for two assault and a mischief convictions and imposed a term of one year reporting probation on him. She also ordered him to provide Corrections services with a DNA sample.

The probation conditions include Smith taking recommended assessment, counselling or treatment; living where directed; and refraining from possessing or consuming alcoholic beverages or non-medially prescribed drugs.

Smith committed the offenses in Windsor Nov. 9. He pleaded guilty to the charges Feb. 26.

Defrauded businesses

Judge MacDonald suspended sentencing April 8 on Kennetcook resident Garett Eugene Harvie, 37, on three charges of defrauding businesses by means of worthless cheques, and imposed a term of six month reporting probation on him.

The conditions of the probation order include that he stay away from the victim businesses.

Harvie committed the first fraud at a Noel business between March 5 and 12, 2007; the second at a Rawdon Gold Mines establishment March 8; and the third at a Kennetcook business between March 5 and 12. They all involved worthless cheques for $59.68. He pleaded guilty to the charges Sept. 11.

Probation for threats, breaches

Three Mile Plains resident Christopher Frederick Caldwell, 23, pleaded guilty April 8 to two counts of failing to comply with court undertakings. He had previously pleaded guilty to uttering a threat to do a person bodily harm and another to damage a person’s property.

Judge MacDonald suspended sentencing on Caldwell for the convictions and imposed a term of one year reporting probation on him.

The probation conditions include Caldwell taking any recommended assessment, counselling or treatment; his refraining from possessing or consuming alcoholic beverages or non-medically prescribed drugs; a ban on his attending establishments the primary purpose of which is the sale of alcoholic beverages; his not possessing firearms or ammunition; and a prohibition on his communicating or contacting with specific persons and going near their homes.

Caldwell committed the threats in Three Mile Plains May 31, 2007, and pleaded guilty to damage threat June 26, and the bodily harm threat Dec. 18.

Caldwell committed the first undertaking breach in Three Mile Plains Oct. 6, when he communicated with a person, from whom he was prohibited doing so. And he committed the second breach in Windsor Jan. 28, 2008, when he failed to comply with an order not to consume alcoholic beverages or other intoxicants.
