Exceeded legal limit

The court has fined Robert Dwight Kelly, 37, Garland’s Crossing, for having care or control of a motor vehicle having consumed alcohol in such a quantity that the concentration thereof in his blood exceeded the legal limit.

Kelly entered a not guilty plea to the charge April 24, 2007 and the matter was adjourned to Oct. 23, 2007 for trial. Kelly was found guilty following the trial Oct. 23.

He was fined a total of $977.50 and has been given until Nov. 27, 2007 to pay or spend 16 days in custody on willful default. The court has imposed a one-year driving prohibition order against Kelly.

Kelly committed the offence in Windsor March 4, 2007 when he was found to have care or control of a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Kelly gave breathalyzer readings of 120 and 120.

Breathalyzer offence

The court has fined Lawrence Langthorne, 54, Kentville, for having care or control of a motor vehicle having consumed alcohol in such a quantity that the concentration thereof in his blood exceeded the legal limit.

Langthorne entered a guilty plea to the charge Oct. 23, 2007. He was fined a total of $1,035 and has been given until Nov. 6, 2007 to pay or spend 17 days in custody on willful default. The court has imposed a one-year driving prohibition order against Langthorne.

Langthorne committed the offence in Hantsport Sept. 8, 2007 when he was found to have care or control of a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Langthorne gave breathalyzer readings of 190 and 180.
