Probation for assault with weapon

A Greenwich man received a term of reporting probation for an assault with a weapon he committed last year.

In Kentville provincial court Oct. 3, Judge Alan Tufts suspended sentencing on Edward Earl Elliott, 48, for a conviction of assault with a weapon, and imposed a term of two years’ reporting probation on him.

The probation conditions include, among others, Elliott taking assessment, counselling or treatment recommend by Corrections officials; refraining from contacting the victim and refraining from possession of weapons.

Judge Tufts also imposed a 10-year firearms prohibition on the accused.

Elliott committed the assault in Greenwich July 18, 2006. The court found him guilty of the charge Jan. 3.

Probation for indecent act

Judge Tufts suspended sentencing Oct. 3 on Greenwich resident Jeffery Terrance Schofield, 31, for a conviction of performing an indecent act in a public place in the presence of one or more persons, and imposed a term of one year reporting probation on him.

Probation conditions include that Schofield take any assessment, counselling or treatment recommended by Corrections officials.

Schofield committed the indecent act in Wolfville Aug. 4, 2006.

The court found him guilty of the charge June 7.

Breath sample refusal nets fine

Judge Tufts found Bridgetown resident David Wade Eisner, 61, guilty Oct. 3 of refusing to give a breath sample for blood-alcohol analysis, and fined him $650 or 10 days in custody on willful default.

The judge also prohibited Eisner from driving in Canada for one year, a period the Nova Scotia Registry of Motor Vehicles will at least match.

Eisner committed the refusal at 14 Wing Greenwood Feb. 17.

Fined for breach

New Minas resident Matthew Paul O’Neil (Criss), 24, pleaded guilty Oct. 2 to failing to comply with a court undertaking.

Judge Claudine MacDonald fined O’Neil $100 plus a $15 victim surcharge, or one day in custody on willful default.

O’Neil committed the breach in Kentville Sept. 26.

Convicted automatically

Judge MacDonald convicted automatically Blue Mountain resident Paul Henry Sawicki, 43, on a charge of driving without the required liability insurance, contrary to the MVA, and fined him $1,250.

Police laid the charge in Blue Mountain April 29. Sawicki pleaded not guilty to the charge May 28. He didn’t attend court for the Sept. 26 trial, though the court had received a letter from him.

In other court matters

Judge MacDonald found Berwick resident Judy Renee King, 29, guilty Oct. 2 of driving one to 15 kilometres per hour in excess of the posted speed limit, contrary to the Nova Scotia Motor Vehicles Act.

The judge fined King $93.91 plus a $14.09 victim surcharge and $107 costs.

King committed the offense on Highway 101 near Berwick May 9.
