Federal time for drug trafficking

Martin Edward Borden, 56, of North Kentville, has been sentenced to federal time for possessing cocaine for the purpose of trafficking and time deemed served for cocaine possession and two counts of failing to comply with his recognizance.

Borden pleaded not guilty to the charge of possessing cocaine for the purpose of trafficking and a charge of possessing marijuana for the purpose of trafficking on Oct. 11, 2013. The matters were adjourned for trial but Borden changed his plea to guilty on April 8 to the cocaine trafficking charge. The matters were adjourned to June 2 to allow time for a pre-sentence report to be prepared and for sentencing and for disposition on the marijuana charge.

Judge Alan Tufts sentenced Borden to three years in federal custody for trafficking cocaine. The court granted a forfeiture order for items seized, including cash and a cellphone. The court imposed a 13-year firearm prohibition against Borden and granted a DNA order. The court ordered the release of Borden’s cash bail to defence attorney Chris Manning, with the consent of the accused. The charge of possessing marijuana for the purpose of trafficking was withdrawn.

Borden pleaded guilty on June 2 to two counts of failing to comply with his recognizance and the lesser, included offence of cocaine possession. Borden had originally been charged with another count of possessing cocaine for the purpose of trafficking. Borden was sentenced to one day in custody deemed served on these counts.

Borden committed the offences in Windsor on April 5, 2013, in Falmouth on Jan. 10 and in Kentville on Feb. 13.

 

Refused breathalyzer

Gordon George Sangster, 55, of East Noel, has been fined and sentenced to probation for refusing to comply with a demand from a peace officer to provide a sample of his breath for analysis.

Sangster pleaded guilty to the charge on April 8. The matter was adjourned to June 3 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts Tufts fined Sangster a total of $1,755, sentenced him to 15 months of probation and imposed a one-year driving prohibition order against him.

Sangster committed the offence in Kennetcook on Feb. 8. 

 

Impaired driving offences

Shaun Dale Wood, 44, of Newport, has been fined for having the care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Wood pleaded guilty to the charge on June 2. Judge Alan Tufts fined Wood a total of $1,950 and imposed a one-year driving prohibition order against him.

Wood committed the offence in Lower Sackville on April 5. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Wood gave breathalyzer readings of 230 and 220.

Dylan John Pemberton, 20, of Windsor, has been fined and sentenced to probation for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Pemberton pleaded guilty to the charge on June 3. He was fined a total of $1,560, sentenced to six months of probation and had a one-year driving prohibition order imposed against him.

Pemberton committed the offence in Windsor on April 6. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Pemberton gave breathalyser readings of 240 and 230.

Lisa Maria Drader Murphy, 44, of Falmouth, has been fined for operating a motor vehicle while her blood alcohol level exceeded the legal limit.

Murphy pleaded guilty to the charge on June 3. Judge Alan Tufts fined her a total of $1,300 and imposed a one-year driving prohibition order against her.

Murphy committed the offence in Windsor between April 16 and 17. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Murphy gave breathalyzer readings of 140 and 130.
