KENTVILLE, N.S. — A Wolfville man will serve jail time after breaching his conditional sentence order.
Tyler Janz Fairrae, 24, was present in Kentville provincial court in custody on March 21 on allegations that he breached a conditional sentence imposed against him on Feb. 14, 2018. The breach was admitted on a balance of probabilities. The court terminated the conditional sentence and ordered Fairrae to spend the remaining time, 59 days, in custody.
On Valentine’s Day of last year, Judge Ronda Van Der Hoek handed Fairrae a 15-month conditional sentence after he pleaded guilty to eight charges.
The charges included willfully attempting to obstruct, pervert or defeat the course of justice in a judicial proceeding by telling an individual by telephone to recant her statement given to police; two counts of uttering a threat to damage an individual’s automobile, stealing a debit card, two counts of defrauding an individual of a sum of money not exceeding $5,000, failing to comply with his recognizance by having a cell phone and failing to comply with his recognizance by texting, messaging on Facebook and messaging on Snapchat an individual he was ordered to have no contact with.
The conditional sentence included daily curfew from 6 p.m. to 6 a.m. for the first six months, followed by daily curfew from 11 p.m. to 6 a.m. for the remaining time.
According to court documents, Fairrae breached his conditions between Sept. 14 and Oct. 11, 2018, by failing to keep the peace and to be of good behaviour; failing to appear before the court when required and failing to attend and to apply himself to his education at the Nova Scotia Community College.
A warrant was issued for Fairrae’s arrest in New Brunswick on Sept. 19, 2018, after he failed to appear in provincial court in Fredericton on charges of fraud and failing to comply with probation.
Fairrae was charged by the Wolfville RCMP on Sept. 14, 2018, with failing to comply with probation following an incident where it was alleged that he consumed alcohol, contrary to his conditions.
Fairrae was removed from his program of study at the Nova Scotia Community College in October 2018 for not successfully completing expectations as outlined.
Fairrae breached his conditional sentence in New Minas on March 18 by failing to keep the peace and to be of good behaviour. He was in custody, charged with fraud and uttering threats. These charges have not been proven in court.
It’s alleged that the Kings RCMP received a complaint from a woman advising that she had met Tyler Marriot – later identified by police as Tyler Fairrae – on the dating website Tinder.
He allegedly told her that he was experiencing difficulty accessing his bank account. He asked her to deposit cheques in her account and to withdraw the money for him.
She deposited 14 fraudulent cheques in her into her bank account, totaling $2,588. She was later contacted by her bank, advising her that they had closed her account due to fraudulent activity. The woman then contacted police.
The woman reported to police that she continued to deposit the cheques unwillingly, as she was afraid of Fairrae. He allegedly suggested that people would go after both of them if she did not get the money. She also alleged that Fairrae stated that his father, who resides in Ontario, had killed 23 people. The RCMP then charged Fairrae with fraud and uttering threats.
Fairrae also breached his conditional sentence in June 2018.
