Custody for various offences
Martin Leroy Cleveland Jr., 28, of Kentville, has been sentenced to jail time for two counts of possessing stolen property of a value not exceeding $5,000; five counts of failing to comply with probation and two counts of failing to comply with his recognizance.
Cleveland changed his pleas to guilty to eight of the charges and pleaded guilty to the ninth charge on Sept. 19. Judge Claudine MacDonald sentenced Cleveland to six months in custody on the first count of possession of stolen property and sentenced him to three months in custody – to be served concurrently – on each of the remaining eight charges. Cleveland was also sentenced to 12 months of probation on the nine charges.
Cleveland committed the offences in Kentville on April 23 and May 21 and in New Minas on Sept. 16. Two more counts of possessing stolen property of a value not exceeding $5,000 were dismissed on Sept. 19.
Custody for recognizance offence
Joel Mathew Gibson, 38, of Windermere, has been sentenced to jail time for failing to comply with his recognizance with regard to house arrest.
Gibson pleaded guilty to the charge on Sept. 18. Judge Ronda Van Der Hoek sentenced Gibson to 30 days in custody.
Gibson committed the offence in Windermere on Aug. 22. Another count of failing to comply with his recognizance was withdrawn on Sept. 18.
Distributed intimate image
Kyler Issac Devenne, 24, of Sylvan Lake, Alberta, has been handed a conditional sentence order for knowingly distributing an intimate image of an individual, a photograph, knowing that the person depicted in the image did not give their consent.
Devenne pleaded guilty to the charge on Dec. 18, 2018. The matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing.
On Sept. 17, Judge Ronda Van Der Hoek handed Devenne a 16-month conditional sentence order, including house arrest for the first six months, to be followed by daily curfew from 10 p.m. to 6 a.m. for the remaining 10 months.
The court granted a primary DNA order and imposed a 10-year Sex Offender Information Registration Act (SOIRA) order against Devenne. The court also imposed a one-year internet prohibition against Devenne.
Devenne committed the offence in Three Mile Plains on May 27, 2016.
Death threat, probation offence
Diane Carol Bruce, 46, of Wilmot, has been handed a suspended sentence with probation for uttering a death threat and failing to comply with probation.
Bruce pleaded guilty to the charges on July 16 and the matters were adjourned to Sept. 18 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Ronda Van Der Hoek handed Bruce a suspended sentence with 12 months of probation on the two charges.
Bruce committed the offences in Auburn on April 22. Another count of uttering a death threat was withdrawn on Sept. 18.
Conditional discharge for assault
Tyler Francis Hibbert, 28, of Wilmot, has been handed a conditional discharge with probation for committing an assault.
Hibbert changed his plea to guilty on Sept. 18. Judge Ronda Van Der Hoek handed Hibbert a conditional discharge with nine months of probation.
Hibbert committed the offence in Greenwood on March 7. A charge of dangerous driving was dismissed on Sept. 18.
Firearm offence
Nicholas Graham Lepine, 39, of Donnelly’s Brook, has been fined for storing a firearm, a shotgun, in a careless manner.
Lepine changed his plea to guilty on Sept. 18. Judge Ronda Van Der Hoek fined Lepine $200 and granted a forfeiture order.
Lepine committed the offence in Morden on April 16. Two counts of failing to comply with his recognizance by being in possession of a knife; a charge of failing to comply with his recognizance by being in possession of a shotgun and a charge of possessing a firearm, a shotgun, without holding the necessary licence were dismissed on Sept. 18.
Assault, probation offence
Gilbert Edward Harris, 77, of Waterville, has been handed a suspended sentence for committing an assault and has been fined for failing to comply with probation.
Harris changed his pleas to guilty on Sept. 19. Judge Claudine MacDonald handed Harris a suspended sentence with six months of probation for committing an assault and fined him $200 for failing to comply with probation.
Harris committed the offences in Kentville on March 16.
Suspended sentence for recognizance offence
Caleb Michael Spencer, 25, of North Kentville, has been handed a suspended sentence with probation for failing to comply with his recognizance.
Spencer changed his plea to guilty on Sept. 19. Judge Claudine MacDonald handed Spencer a suspended sentence with six months of probation, including 20 hours of community service work.
Spencer committed the offence in Kentville on April 18. Three more counts of failing to comply with his recognizance and a charge of assault were dismissed on Sept. 19.
