Custody for assault, failing to comply
Thomas James Rafuse, 34, of Greenwood, has been sentenced to time in custody for assault, failing to comply with his recognizance and failing to comply with probation.
Rafuse was present in custody for a court appearance on Nov. 2. The Crown was opposed to his release and Rafuse was denied bail following a show cause hearing. He was remanded in custody on a due course of law remand. Rafuse pleaded not guilty and the matters were adjourned to Nov. 29 for trial.
Rafuse changed his pleas to guilty prior to the scheduled trial on Nov. 29. Exhibits were entered and a victim impact statement was read. Judge Rickola Brinton sentenced Rafuse to four months in custody on the assault charge. Rafuse was given credit at time-and-a-half for one month spent remanded in custody, leaving two months and 15 days left to serve. Rafuse was sentenced to six months of probation and the court granted a DNA order.
Rafuse was sentenced to one month in custody and six months of probation, to be served concurrently, on each the recognizance charge and the probation charge.
Rafuse committed the offences in Greenwood on Oct. 30. A charge of strangling a person with intent to enable him to commit the indictable offence of assault was dismissed on Nov. 29 with the Crown offering no evidence.
Conditional sentence with house arrest
Brandon Drew Corbin, 21, of Berwick, has been handed a conditional sentence with house arrest for two counts of possessing stolen property valued at less than $5,000; defrauding Reid’s Meat Market of a sum of money not exceeding $5,000, breaking and entering a garage with intent to commit an indictable offence therein and failing to comply with his undertaking.
Corbin pleaded guilty to one count of possessing stolen property on Oct. 10 and pleaded guilty to the other charges on Oct. 24. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.
On Nov. 24, Judge Alan Tufts handed Corbin a six-month conditional sentence order with house arrest for the first three months, followed by daily curfew from 10 p.m. to 6 a.m. Corbin was also sentenced to 12 months of probation. Corbin was ordered to pay $750 in restitution to Reid’s Meat Market as part of his conditional sentence and was ordered to pay $1,250 in restitution to the business as part of his probation.
Eight more counts of possessing stolen property and a charge of break, enter and theft at Elderkin’s Farm Market were withdrawn.
Breathalyser offence, speeding
Mackenzie Ian Daniels, 21, of Edson, Alberta, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit and for driving at a speed that exceeded the posted limit or other maximum speed limit in the Motor Vehicle Act by 31 km/h or more.
Daniels pleaded guilty to the charges on Nov. 28. He had originally been charged with operating a motor vehicle on a highway in a race, contest, while performing a stunt or on a bet or wager but pleaded guilty to the included offence of speeding.
Judge Ronda Van Der Hoek fined Daniels a total of $1,560 for the breathalyser offence and imposed a one-year driving prohibition against him. He was fined a total of $410 for speeding.
Daniels committed the offences in New Minas on Sept. 16. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Daniels gave breathalyser readings of 130 and 120.
Recognizance, probation offences
Brennen Dana Robinson, 33, of Parkers Cove, has been sentenced to time deemed served for failing to comply with his recognizance by consuming alcohol and failing to comply with probation by failing to abstain from possessing or consuming alcohol or other intoxicating substances.
Robinson pleaded guilty to the charges on Nov. 28. He was sentenced to one day in custody deemed served on each charge.
Robinson committed the offences in Wolfville on Nov. 11.
Probation offence
David Christopher Bennett, 42, of Hants Border, has been fined for failing to comply with probation by failing to abstain from consuming alcohol.
Bennett pleaded guilty to the charge on Nov. 28. Judge Alan Tufts fined Bennett a total of $65.
Bennett committed the offence in Hantsport on Oct. 8.
Probation offence, failed to appear
Adam James Foster, 30, of Mount Uniacke, has been fined for failing to comply with probation by failing to abstain from associating with anyone known to have a criminal record or drug record and, having been named in a promise to appear, failing to appear for the purpose of the Identification of Criminals Act.
Foster pleaded guilty to the charges on Nov. 28. Judge Alan Tufts fined Foster $130 on each charge, for a total of $260 in fines.
Foster committed the offences in Windsor on Oct. 6.
Time deemed served for various offences
Dylan Justin Leopold, 24, of Three Mile Plains, has been sentenced to time deemed served for uttering a threat to a woman to burn her house; two counts of failing to comply with his undertaking and failing to comply with his recognizance by failing to comply with a daily curfew condition.
Leopold pleaded guilty to the charges on Oct. 27. He consented to being remanded in custody until his sentencing on Nov. 28. Leopold was sentenced to one day in custody deemed served on each of the four charges.
Leopold committed the offences in Three Mile Plains on Aug. 9 and Oct. 14, 17 and 25. A charge of committing mischief by kicking a car was withdrawn on Nov. 28.
