Conditional sentence with house arrest
Jason Paul Mathany, 33, of Kentville, has been handed a conditional sentence with house arrest and sentenced to time deemed served for two counts of assault and five counts of failing to comply with his recognizance.
Mathany changed his pleas to guilty to the seven charges on Feb. 6 and the matters were adjourned to March 14 to allow time for a pre-sentence report to be prepared and for sentencing.
On one count of assault and on two counts of failing to comply with his recognizance, Judge Christopher Manning handed Mathany conditional sentence orders totaling six months. Mathany will be on house arrest for the entire time. The conditional sentence will be followed by 18 months of probation.
On the other count of assault, Mathany was sentenced to six months in custody, deemed served by time spent remanded in custody. He was sentenced to 18 months of probation, to be served concurrently.
Mathany was sentenced to 30 days in custody on each of the three remaining counts of failing to comply with his recognizance, time which has also been deemed served, and 18 months of concurrent probation.
The court granted primary DNA orders in relation to the assault charges and imposed a 10-year, six-month firearm prohibition against Mathany. He has been given 30 days to surrender any firearms in his possession.
Mathany committed the offences in Middleton between May 1 and June 1, 2018, and in Kentville on Aug. 8, 2018. A charge of uttering a threat to cause bodily harm or death and another count of failing to comply with his recognizance were withdrawn on March 14.
Committed mischief
Maureen Marie O’Hara, 54, of Centreville, has been handed a suspended sentence with probation for committing mischief by willfully damaging an individual’s property – the rear window of a Volkswagen Beetle.
In December, O’Hara pleaded not guilty to this charge and to a charge of committing mischief by willfully damaging the property of the Kentville Police Service to a value not exceeding $5,000. O’Hara stood trial on March 4 and Judge Christopher Manning handed down his decision on March 13.
O’Hara was found guilty of committing mischief by willfully damaging an individual’s property and was found not guilty on the mischief charge involving the Kentville Police Service. Manning handed O’Hara a suspended sentence with nine months of reporting probation. The court granted a standalone restitution order for $863.42, payable to the victim.
O’Hara committed the offence in Kentville on Nov. 6, 2018.
Conditional discharge for assault
Amber Lee Ethridge, 31, of North Kentville, has been handed a conditional discharge with probation for committing an assault.
Ethridge changed her plea to guilty on March 14. Judge Ronda Van Der Hoek handed Ethridge a conditional discharge with nine months of reporting probation.
Ethridge committed the offence in New Minas on Oct. 29, 2017.
Suspended sentence with probation
Paul Joseph Wentzell, 37, of Baxters Harbour, has been handed a suspended sentence with probation for obstructing, interrupting or interfering with an individual’s lawful use, enjoyment or operation of property.
Wentzell was originally charged with criminal harassment but pleaded guilty to the interfering with the lawful use, enjoyment or operation of property charge on March 13. Judge Ronda Van Der Hoek handed Wentzell a suspended sentence with 12 months of probation.
Wentzell committed the offence in Baxters Harbour between Jan. 1 and 25, 2018.
Stole from store
Jordan Donald Delorey, 21, of Kingston, has been handed a conditional discharge with probation for two counts of stealing property of a value not exceeding $5,000 from the Atlantic Superstore.
Delorey pleaded guilty to the charges on Jan. 15 and the matters were adjourned to March 14 to allow time for a pre-sentence report to be prepared and for sentencing.
Judge Ronda Van Der Hoek handed Delorey a conditional discharge with nine months of reporting probation on the two charges. The court granted a standalone restitution order for $269.95, payable to the benefit of the Kingston Atlantic Superstore.
Delorey committed the offences in Kingston on Aug. 28 and Sept. 11, 2018.
Undertaking offence
Caleb Michael Spencer, 24, of Kentville, has been handed a conditional discharge with probation for failing to comply with his undertaking.
Spencer changed his plea to guilty on March 13. Judge Ronda Van Der Hoek handed Spencer a conditional discharge with four months of probation.
Spencer committed the offence in Kentville on March 5, 2018.
