This is the latest court report for Kings and West Hants counties.

Carried knife in committing assault

Jacob Jan Gerrits, 27, of Kentville, has been handed a conditional discharge with probation for carrying a weapon – a knife – in committing an assault.

Gerrits changed his plea to guilty on Nov. 6 and the matter was adjourned to Jan. 7 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Christopher Manning handed Gerrits a conditional discharge with nine months of probation. The court granted a forfeiture order for the knife.

Gerrits committed the offence in Greenwich on Feb. 18, 2018. Another charge of carrying a weapon in committing an assault and a charge of carrying a weapon for the purpose of committing an offence were dismissed on Jan. 7.

Assault, undertaking offence

Alexander Leon Bertrand, 33, of Halifax, has been handed a conditional discharge with probation for committing an assault and failing to comply with his undertaking.

Bertrand changed his pleas to guilty on Jan. 9. Judge Christopher Manning handed Bertrand a conditional discharge with 12 months of reporting probation.

Bertrand committed the offences in Welsford on May 15 and 20, 2018. Another count of assault and two more counts of failing to comply with his undertaking were dismissed on Jan. 9 with the Crown offering no evidence.

Breathalyser offence

Andrew Christopher Machinek, 28, of Kempt Shore, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Machinek pleaded guilty to the charge on Jan. 8. Judge Ronda Van Der Hoek fined Machinek a total of $1,000 and imposed a one-year driving prohibition against him.

Machinek committed the offence in Union Corner on Nov. 16, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Machinek gave breathalyser readings of 140 and 150.

Breathalyser offence

Bradley Lloyd Clarke, 37, of Aylesford, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Clarke changed his plea to guilty on Jan. 9. Judge Christopher Manning fined Clarke a total of $1,560 and imposed a two-year driving prohibition against him.

Clarke committed the offence in Aylesford on Aug. 13. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Clarke gave breathalyser readings of 150 and 140.

Breathalyser offence

Stephen Dykens, 40, of Wolfville, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Dykens changed his plea to guilty on Jan. 8. Judge Christopher Manning fined Dykens a total of $1,950 and imposed a 15-month driving prohibition against him.

Dykens committed the offence in Wolfville on Aug. 7, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Dykens gave breathalyser readings of 140 and 140.

Drove while disqualified

Nicholas Johnathan Caldwell, 29, of Wolfville, has been fined for operating a motor vehicle while disqualified.

Caldwell changed his plea to guilty on Jan. 8. Judge Christopher Manning fined Caldwell a total of $650 and imposed a one-year driving prohibition against him.

Caldwell committed the offence in Avonport on Dec. 28, 2017.

Suspended sentence for stealing from store

Stacey Eugene Beals, 54, of Waterville, has been handed a suspended sentence with probation for stealing property of a value not exceeding $5,000 from the Atlantic Superstore.

Beals changed his plea to guilty on Oct. 24 and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. On Jan. 8, Judge Christopher Manning handed Beals a suspended sentence with nine months of reporting probation.

Beals committed the offence in Kingston on Nov. 16, 2017. The charge against a co-accused, Ann Marie Viner, 56, of Waterville, was dismissed on Jan. 8 with the Crown offering no evidence.

A charge against Beals of stealing property from the Nova Scotia Liquor Corporation of a value not exceeding $5,000 was withdrawn by the Crown on Jan. 8.
