Jail time for recognizance offences
Catlin Stewart Cooke, 28, of Greenwood, has been sentenced to jail time for three counts of failing to comply with his recognizance: by failing to refrain from having any direct contact or communication with a certain individual; by associating with or being in the company of a certain individual and by failing to remain in his residence at all times.
Cooke pleaded guilty to the three charges on Feb. 19. Judge Ronda Van Der Hoek sentenced Cooke to 15 days in custody on each count, to be served consecutively. Cooke was granted a credit of six days on each count for time spent remanded in custody, leaving 27 days left to serve.
Cooke committed the offences in New Minas on Feb. 7. Two more counts of failing to comply with his recognizance and a charge of failing to comply with probation were withdrawn on Feb. 19.
Breathalyser offence
Brett Robert Lloyd Deadder, 27, of Canning, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit and for being a newly licenced driver operating or having care or control of a motor vehicle with alcohol in his blood.
Deadder changed his plea to guilty to the breathalyser offence in November. The court imposed a one-year driving prohibition against Deadder and the matter was adjourned to Feb. 15 to allow time for a pre-sentence report to be prepared and for sentencing. Deadder pleaded guilty to the other charge on Feb. 15.
Judge Christopher Manning fined Deadder a total of $1,500 for the breathalyser offence and fined him a total of $410 for being a newly licensed driver operating or having care or control of a motor vehicle with alcohol in his blood.
Deadder committed the offences in Ellershouse on May 12, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Deadder gave breathalyser readings of 140 and 130.
Breathalyser offence
Christopher Amis Parker, 57, of Brooklyn, has been fined for having a blood alcohol concentration equal to or exceeding the legal limit within two hours after ceasing to operate a conveyance.
Parker pleaded guilty to the charge on Feb. 19. Judge Christopher Manning fined Parker a total of $2,000 and imposed a one-year driving prohibition against him.
Parker committed the offence in Brooklyn on Jan. 11. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Parker gave breathalyser readings of 160 and 160.
A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on Feb. 19.
Refused breathalyser
Robert B. Benedict, 76, of Mount Denson, has been fined for refusing to comply with a demand made to him by a police officer to provide a sample of his breath for analysis by means of an approved screening device.
Benedict pleaded guilty to the charge on Feb. 19. Judge Christopher Manning fined Benedict a total of $1,000 and imposed a one-year driving prohibition against him.
Benedict committed the offence in Windsor on Nov. 12, 2018. A charge of operating a motor vehicle while his ability to do so was impaired by alcohol was withdrawn by the Crown on Feb. 19.
Conditional discharge for threats
Alan Richard Dauphinee, 38, of Windsor, has been handed a conditional discharge with probation for uttering a death threat and, by word of mouth, conveying a threat to an individual to cause death to two other individuals.
Dauphinee was found guilty on both counts on Dec. 12, 2018, and the matters were adjourned to Feb. 19 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Christopher Manning handed Dauphinee a conditional discharge with 15 months of probation on the two charges.
Dauphinee committed the offences in Windsor on April 2 and Aug. 4, 2018.
Failed to attend court
Derrick Wilson, 28, of New Minas, has been fined for failing to attend court in accordance with a Promise to Appear in which he had been named.
Wilson changed his plea to guilty to the charge on Feb. 20. Judge Ronda Van Der Hoek fined Wilson a total of $200.
Wilson committed the offence in Kentville on Sept. 26, 2017.
