This is the latest court report for Kings and West Hants counties.

Conditional discharge for mischief

Morgan Aaron Davidson, 22, address unknown, formerly of Yarmouth, has been handed a conditional discharge with probation for committing mischief by breaking a window.

Davidson pleaded guilty to the charge on Jan. 29 and the matter was adjourned to Feb. 11 for sentencing.

Judge Ronda Van Der Hoek handed Davidson a conditional discharge with eight months of probation, including $263.48 in restitution to The Rolled Oat Café.

Davidson committed the offence in Wolfville on March 29, 2018.

Breathalyser offence

Mark John Rhodenizer Smith, 27, of Pine Grove, has been fined for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Smith pleaded guilty to the charge on Feb. 12. Judge Rhonda Van Der Hoek fined him a total of $3,000, sentenced him to one year of probation and imposed a three-year driving prohibition against him.

Smith committed the offence in Cross Burn on Oct. 7, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Smith gave breathalyser readings of 300 and 290.

Exceeded legal limit

Matthew J. Jobes, 37, of Greenwood, has been fined for having a blood alcohol concentration equal to or exceeding the legal limit within two hours after ceasing to operate a conveyance.

Jobes pleaded guilty to the charge on Feb. 12. Judge Rhonda Van Der Hoek fined Jobes a total of $1,000 and imposed a one-year driving prohibition against him.

Jobes committed the offence in Aylesford on Dec. 22, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Jobes gave breathalyser readings of 100 and 80.

A charge of operating a conveyance while his ability was impaired to any degree by alcohol, a drug, or both, was withdrawn on Feb. 12.

Probation offence

Deven Richard Dalton, 30, of Cambridge, has been handed a conditional discharge with probation for failing to comply with probation by failing to refrain from the consumption of drugs and alcohol.

Dalton changed his plea to guilty on Feb. 13. Judge Rhonda Van Der Hoek handed Dalton a conditional discharge with six months of probation.

Dalton committed the offence in Cambridge on July 1, 2018.

Undertaking offence

Mitchell James Ellis, 42, of North Kentville, has been handed a conditional discharge with probation for failing to comply with his undertaking.

Ellis changed his plea to guilty on Feb. 13. Judge Rhonda Van Der Hoek handed Ellis a conditional discharge with three months of probation, including a $250 charitable donation to Chrysalis House within the first two months.

Ellis committed the offence in Kentville on Jan. 30, 2018.
