Conditional sentences with house arrest
Nathan Richard Eagles, 34, of New Minas, has been handed a conditional sentence order with house arrest and sentenced to probation for committing an assault causing bodily harm.
Eagles changed his plea to guilty in October and the matter was adjourned to Nov. 22 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Claudine MacDonald handed Eagles a six-month conditional sentence order with house arrest for the first three months, to be followed by daily curfew from 10 p.m. to 6 a.m. for the remaining three months. The conditional sentence is to be followed by 12 months of probation. The court granted a DNA order and imposed a 10-year firearm prohibition against Eagles.
Eagles committed the offence in New Minas on April 6. Another charge of assault causing bodily harm was dismissed with the Crown offering no evidence.
Jeffrey Allen Graves, 43, of Wilmot, has been handed a conditional sentence with house arrest after pleading guilty to committing criminal harassment by besetting or watching a woman at her place of work, thereby causing the woman to, in all the circumstances, reasonably fear for her safety; and failing to comply with his recognizance.
Graves pleaded guilty to the charges on Oct. 17 and the matters were adjourned to Nov. 21 to allow time for a pre-sentence report to be updated and for sentencing.
Judge Alan Tufts handed Graves a four-month conditional sentence order, including house arrest for the first month followed by daily curfew from 9 p.m. to 5 a.m. for the next two months. The conditional sentence is to be followed by eight months of probation.
Graves committed the offences in New Minas between Jan. 5 and 6. A charge of publishing, distributing, transmitting, selling, making available or advertising an intimate image knowing that the person depicted in the image did not give consent to that conduct and another count of failing to comply with his recognizance were dismissed on Nov. 21 with the Crown offering no evidence.
Veronica Charlene Weihers, 50, of Aylesford, has been handed a conditional sentence order with house arrest for carrying a weapon, a knife, that she wasn’t authorized to carry, failing to comply with probation and possessing a weapon while prohibited from doing so.
Weihers changed her pleas to guilty in September and the matters were adjourned to Nov. 23 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Claudine MacDonald handed Weihers a 60-day conditional sentence order with house arrest for the entire time and one year of reporting probation on the three charges. Weihers was fined a total of $300 in victim surcharges.
Weihers committed the offences in Dartmouth on Aug. 5, 2015. Another count of possessing a prohibited weapon and another count of failing to comply with probation were dismissed on Nov. 23.
Stored firearm in careless manner
Nicholas Edward Dorey, 35, of Aylesford, has been fined for storing a firearm, a rifle, in a careless manner or without reasonable precaution for the safety of others.
Dorey pleaded guilty to the charge on Nov. 21. Judge Claudine MacDonald fined Dorey a total of $195.
Dorey committed the offence in Aylesford on June 28. A charge of possessing a firearm and ammunition while prohibited from doing so was withdrawn on Nov. 7.
Suspended sentence for various offences
Melody Susan Margaret Gallie, 23, of Martock, has been handed a suspended sentence with probation for committing an assault, failing to comply with her undertaking, unlawfully possessing cannabis marijuana and two counts of failing to comply with her recognizance.
Gallie pleaded guilty to the assault charge on Sept. 22. Gallie was present in Windsor provincial court in custody on Nov. 17, when she pleaded guilty to the other charges. Judge Ronda Van Der Hoek handed Gallie a suspended sentence with six months of probation on the five charges.
Gallie committed the offences in Windsor on June 28, Sept. 19 and Oct. 17 and in Martock on Oct. 11.
Charges of unlawfully possessing hydromorphone and break and enter into an apartment with intent to commit an indictable offence therein were withdrawn on Nov. 17.
Impaired driving, evaded police
Jeremy Eugene Baker, 20, of New Minas, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit; failing to stop his vehicle as soon as was reasonable in the circumstances in order to evade police and failing to comply with probation.
Baker pleaded guilty to the charges on Oct. 10 and the matters were adjourned to Nov. 23 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Claudine MacDonald fined Baker a total of $1,300 on the impaired driving charge and imposed an 18-month driving prohibition against him. Baker was fined a total of $520 for failing to stop for police and he was fined a total of $65 for failing to comply with probation.
Baker committed the offences in Kentville on July 29. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Baker gave breathalyser readings of 120 and 110.
Breathalyser offences
Jakob Fardy, 19, of Coldbrook, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Fardy pleaded guilty to the charge on Nov. 21. Judge Claudine MacDonald fined Fardy a total of $1,300 and imposed a one-year driving prohibition against him.
Fardy committed the offence in Wolfville on Sept. 10. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Fardy gave breathalyser readings of 110 and 110.
Everett Liam Mahoney, 31, of Coldbrook, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Mahoney pleaded guilty to the charge on Nov. 21. Judge Claudine MacDonald fined him a total of $1,560 and imposed a one-year firearm prohibition against him.
Mahoney committed the offence in Coldbrook on Aug. 30. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Mahoney gave breathalyser readings of 170 and 170.
Michael Allen McCulley, 49, of Baxter’s Harbour, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
McCulley pleaded guilty to the charge on Nov. 21. Judge Claudine MacDonald fined McCulley a total of $1,690, sentenced him to one year of reporting probation and imposed a two-year driving prohibition against him.
McCulley committed the offence in Kentville on Oct. 7. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. McCulley gave breathalyser readings of 180 and 180.
Refused breathalyser
Michael James Robicheau, 48, of New Minas, has been fined for failing to comply with a demand made to him by a police officer to provide samples of his breath for analysis to determine the concentration, if any, of alcohol in his blood.
Robicheau changed his plea to guilty on Nov. 22. Judge Alan Tufts fined him a total of $1,560 and imposed a one-year driving prohibition against him.
Robicheau committed the offence in New Minas on Dec. 3, 2016.
Curative treatment discharge
John Alexander Vanoostrum, 44, of Somerset, has been handed a curative treatment discharge with probation for operating a motor vehicle while his blood alcohol level exceeded the legal limit; and has been handed a conditional sentence order for operating a motor vehicle while disqualified.
Vanoostrum changed his plea to guilty on the impaired driving charge on March 8 and changed his plea to guilty to the driving while disqualified charge on March 14. The court imposed a four-year driving prohibition against Vanoostrum on March 14 and a pre-sentence report was ordered on June 28.
Vanoostrum’s application for a curative treatment discharge was heard on Nov. 22. Judge Alan Tufts handed Vanoostrum a curative discharge with two years of probation on the impaired driving charge. Tufts handed Vanoostrum a three-month conditional sentence on the driving while disqualified charge, with daily curfew from 9 p.m. to 6 a.m. for the entire time. A two-year driving prohibition was imposed, concurrent to the previously imposed four-year prohibition.
Vanoostrum committed the offences in Weston on Sept. 4, 2015. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Vanoostrum’s blood alcohol reading was 347.
A charge of operating a motor vehicle while his ability to do so was impaired by alcohol or a drug was dismissed on Nov. 22.
Fisheries Act offences
David Gary Hiltz, 39, of Round Hill, Annapolis County, has been fined and handed a suspended sentence with probation for two offences under the Fisheries Act.
Hiltz changed his pleas to guilty on Nov. 23 to charges of possessing more fish of a species taken by recreational fishing than the applicable daily fishing quota for that species; and catching and retaining striped bass shorter than the minimum length.
Judge Claudine MacDonald fined Hiltz a total of $100 on the first charge and handed him a suspended sentence with eight months of probation, including 50 hours of community service work, on the second charge. The court granted a forfeiture order for items seized in relation to the charges.
Hiltz committed the offences in Porter Point, Kings County, on Oct. 28, 2016.
Caused disturbance
Kolby Giffin Pineo, 20, of Kentville, has been handed a conditional discharge with probation for causing a disturbance in a public place, West Side Charlies, by fighting and shouting.
Pineo changed his plea to guilty on Nov. 22. Judge Claudine MacDonald handed Pineo a conditional discharge with six months of probation, including 20 hours of community service work. Pineo was fined $100 in victim surcharges.
Pineo committed the offence in New Minas on March 18. A charge of assaulting a police officer engaged in the execution of her duty was dismissed on Nov. 22 with the Crown offering no evidence.
