Conditional sentence suspended

Nathan Richard Eagles, 34, of New Minas, will serve 30 days in custody after failing to comply with his conditional sentence order.

On Nov. 22, Eagles was handed a conditional sentence order with house arrest and sentenced to probation for committing an assault causing bodily harm. He had changed his plea to guilty in October.

Judge Claudine MacDonald handed Eagles a six-month conditional sentence order with house arrest for the first three months, to be followed by daily curfew from 10 p.m. to 6 a.m. for the remaining three months. The conditional sentence is to be followed by 12 months of probation. The court granted a DNA order and imposed a 10-year firearm prohibition against Eagles.

Eagles committed the offence in New Minas on April 6. Another charge of assault causing bodily harm was dismissed on Nov. 22 with the Crown offering no evidence.

On Dec. 18, an arrest warrant was issued for Eagles for allegedly breaching conditions. The warrant was executed on Dec. 24 and Eagles was remanded in custody. On Dec. 27, Eagles’ conditional sentence was suspended for 30 days. He had breached his house arrest condition and a condition not to possess, take or consume alcohol or other intoxicating substances on Dec. 17.

Following the suspension, Eagles’ conditional sentence order will resume with the same conditions.
