This is the latest court report for Kings and West Hants counties.

Time deemed served

Brennen Dana Robinson, 35, of Granville Ferry, has been sentenced to time deemed served for committing an assault, uttering a threat to cause bodily harm and three counts of failing to comply with his recognizance.

Following a trial, Robinson was found guilty on all counts. The matters were adjourned to May 22 for sentencing.

Judge Christopher Manning sentenced Robinson to a total of 60 days in custody on the five charges. Robinson had spent 40 days remanded in custody and was given credit at time-and-a-half, totaling 60 days, so the time is deemed served. Robinson was also sentenced to 18 months of probation.

Robinson committed the offences in Kentville on April 12 and in Kingston on April 13.

Robinson is also charged with carrying a weapon, a knife, in committing an assault; assault and failing to comply with probation. It’s alleged that he committed these offences in Parkers Cove on Sept. 23, 2017. These charges have not been proven in court.

On May 22, Robinson consented to be remanded in custody until May 28, when the Crown is expected to make an application to revoke his conditional release with respect to these three charges.

Breathalyser offence, resisted police

Joshua Martin Keddy, 38, of Kingston, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit and has been handed a suspended sentence with probation for resisting a police officer engaged in the execution of his duty.

Evidence was heard at a trial on May 23 but Keddy changed his pleas to guilty to the two charges.

Judge Christopher Manning fined Keddy a total of $1,200 and imposed a one-year driving prohibition against him for operating a motor vehicle while his ability to do so was impaired by alcohol. Keddy was handed a suspended sentence with 12 months of reporting probation for resisting a police officer.

Keddy committed the offences in New Minas on May 19, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Keddy gave breathalyser readings of 150 and 140.

Charges of operating a motor vehicle while he was impaired by alcohol, dangerous driving and failing to stop his vehicle as soon as was reasonable in the circumstances in order to evade police were dismissed on May 23 with the Crown offering no further evidence.

Breathalyser offence, failed to attend court

Chad Edward Hogan, 43, of Waterville, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit and for failing to attend court in accordance with a promise to appear in which he had been named.

Hogan pleaded guilty to the charges on May 21. Judge Christopher Manning fined Hogan $1,000 for operating a motor vehicle while his blood alcohol level exceeded the legal limit and imposed a one-year driving prohibition against him. Hogan was fined $150 for failing to attend court.

Hogan committed the offences in Berwick on July 27, 2018, and in Kentville on Sept. 25, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Hogan gave breathalyser readings of 140 and 130.

Refused breathalyser

Robyn Anne Mitchell, 34, of Kentville, has been fined for failing to comply with a demand made to her by a police officer to provide samples of her breath for analysis to determine the concentration, if any, of alcohol in her blood.

Mitchell changed her plea to guilty on May 21. Judge Ronda Van Der Hoek fined Mitchell a total of $1,000 and imposed a one-year driving prohibition against her.

Mitchell committed the offence in White Rock on April 23, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood.

Curative treatment discharge

John Murphy, 27, of Wolfville, has been handed a curative treatment conditional discharge for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Murphy pleaded guilty to the charge on Sept. 25, 2018. The court imposed a one-year driving prohibition against Murphy and the matter was adjourned to allow time for a pre-sentence report to be prepared, a curative treatment application to be made and for sentencing.

On May 22, Judge Ronda Van Der Hoek handed Murphy a curative treatment conditional discharge with 12 months of probation, including 20 hours of community service work.

Murphy committed the offence in Wolfville on July 29, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Murphy gave breathalyser readings of 200 and 200.

Undertaking, probation offences

Daniel William Morley, 38, of Paradise, has been handed a suspended sentence with probation for three counts of failing to comply with his undertaking and three counts of failing to comply with probation.

Morley pleaded guilty to one count of failing to comply with probation on March 26 and pleaded guilty to the other five charges on May 21. Judge Christopher Manning handed Morley a suspended sentence with 18 months of reporting probation on the six charges.

Morley committed the offences in Greenwood on Dec. 28, 2018; on March 12, 2019, and on May 17, 2019; in North Kentville on April 2, 2019, and in Berwick on May 16, 2019.

Two more counts of failing to comply with probation, another count of failing to comply with his undertaking and a charge of loitering at night near a house were withdrawn on May 21.

Morley pleaded not guilty to a charge of assault on May 21. This matter has been adjourned to Oct. 2 for trial.

Probation offences

Bradley John Hubbard, 37, of Kentville, has been fined for two counts of failing to comply with probation - by failing to comply with a condition to have no direct or indirect contact with an individual without her express consent and by failing to keep the peace and to be of good behaviour.

Hubbard changed his pleas to guilty on Feb. 26. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On May 21, Judge Ronda Van Der Hoek fined Hubbard $400 on the first count and fined him $100 on the second count.

Hubbard committed the offences in Halifax on June 29, 2018.
