This is the latest court report for Kings and West Hants counties.

Fined for Animal Protection Act offences

Amanda Wright, of Kentville, has been fined under the Animal Protection Act for failing to provide a rabbit with an adequate source of food and water and causing the animal to be in distress.

Wright pleaded guilty to the two charges on March 13. She was fined $500 on each count. The court also imposed a prohibition against Wright on having care or control of animals for 10 years, with the exception of three existing cats, which are to be identified to the Crown.

Wright committed the offences in Kentville between Oct. 12 and 14, 2017.

Breathalyser, motor vehicle offences

Jesse Malcolm Roy Fuller, 27, of Kentville, has been handed a curative treatment conditional discharge for operating a motor vehicle while his blood alcohol level exceeded the legal limit and has been fined for driving while disqualified, driving without insurance and displaying a number plate issued for another vehicle.

Fuller pleaded guilty to the charges on Dec. 5, 2017, and the matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing. Notice of increased penalty was filed and the court imposed a two-year driving prohibition against Fuller.

On March 14, Judge Alan Tufts handed Fuller a curative treatment conditional discharge with two years of probation, including a $500 charitable donation to the Red Door, for operating a motor vehicle while his blood alcohol level exceeded the legal limit. Fuller was fined $100 in victim surcharges.

Fuller was fined $650 for driving while disqualified; $1,000 for driving without insurance and $50 for displaying a number plate issued for another vehicle.

Fuller committed the offences in Canning on Oct. 8, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Fuller gave breathalyser readings of 150 and 150.

A charge of operating a motor vehicle while his ability to operate was impaired by alcohol or a drug was withdrawn on March 14.

Breathalyser offence

Scott Calvin Banfield, 41, of Bedford, has been handed a curative treatment conditional discharge for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Banfield pleaded guilty to the charge on Dec. 4, 2017. The court imposed a one-year driving prohibition against him. The matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On March 9, Judge Ronda Van Der Hoek handed Banfield a curative treatment conditional discharge with 18 months of probation. Banfield was also fined $100 in victim surcharges.

Banfield committed the offence in Upper Burlington on Sept. 23, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Banfield gave breathalyser readings of 160 and 170.

Breathalyser offence

Steven Dale Hall, 33, of Margaretsville, has been handed a curative treatment conditional discharge for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Hall changed his plea to guilty on Dec. 12, 2017, and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. The court imposed a one-year driving prohibition against Hall.

On March 14, Judge Alan Tufts handed Hall a curative treatment conditional discharge with 18 months of probation, including a $500 charitable donation to the Red Door.

Hall committed the offence in Kentville on Jan. 6, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Hall gave breathalyser readings of 120 and 110.

Conditional sentence for probation offence

Adam James Foster, 30, of Mount Uniacke, has been handed a conditional sentence order with house arrest for failing to comply with probation.

Foster pleaded guilty on Jan. 23 and the matter was adjourned to March 12 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts handed Foster a six-week conditional sentence order, including house arrest for the first three weeks, and fined him $100 in victim surcharges.

Foster committed the offence in Windsor on Nov. 1, 2017.

Fined for various offences

Jorden William Keddy, 22, of Kentville, has been fined for two counts of failing to comply with his undertaking; careless and imprudent driving and operating a motor vehicle while his ability to operate was impaired by alcohol or a drug.

Keddy pleaded guilty to the charges on March 13. Judge Claudine MacDonald fined Keddy $195 on each of the undertaking charges. Keddy was fined $410 for careless and imprudent driving and had his driver’s licence suspended for seven days. He was fined $1,300 on the impaired driving charge and the court imposed a one-year driving prohibition against him.

Keddy committed the offences in New Minas on Nov. 18, 2017, and in Kentville on Dec. 2, 2017. Charges of failing to stop his vehicle and give his name and address with intent to escape civil or criminal liability having been involved in an accident and unlawfully failing to stop his vehicle and give his name and address were withdrawn on March 13.

Keddy pleaded not guilty to charges of assault and being intoxicated in a public place on March 13. These charges, which have not been proven in court, have been adjourned to Aug. 8 for trial. It’s alleged that Keddy committed these offences in New Minas on Nov. 9, 2017.

Fine, probation for stealing property

Caleb Malique Joshua Neary, 22, of Dartmouth, has been fined and sentenced to probation for stealing property valued at less than $5,000 from an individual.

Neary pleaded guilty to the charge on March 13. Judge Claudine MacDonald fined Neary a total of $260 and sentenced him to 12 months of reporting probation.

Neary committed the offence in Wolfville on Aug. 23, 2017. Charges of possessing stolen property of a value exceeding $5,000 and using a forged cheque as if it were genuine were withdrawn on March 13.

Fine, probation for stealing from store

Tanya Whynot, 41, of Greenwood, has been fined and sentenced to probation for stealing merchandise valued at less than $5,000 from the Atlantic Superstore.

Whynot pleaded guilty to the charge on March 13. Judge Claudine MacDonald fined her a total of $65 and sentenced her to one year of reporting probation, including restitution of $233.32 to the New Minas Atlantic Superstore.

Whynot committed the offence in New Minas on Nov. 15, 2017.

Suspended sentence for assault, undertaking offence

Jonathan Evan Thomas, 23, of Lucasville, has been handed a suspended sentence with probation for committing an assault and failing to comply with his undertaking.

Thomas changed his pleas to guilty on March 14. Judge Alan Tufts handed Thomas a suspended sentence with 12 months of probation on the two charges and fined him $100 in victim surcharges on each count.

Thomas committed the offences in Sunken Lake on Aug. 7 and Sept. 17, 2017.

Conditional discharge with probation

Andrea Carlie Wood, 19, of Coldbrook, has been handed a conditional discharge with probation for committing an assault, willfully damaging property to a value not exceeding $5,000 and failing without lawful excuse to attend court as directed by a judge.

Wood pleaded guilty to the assault charge and the charge of willfully damaging property on April 25, 2017. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing. Wood pleaded guilty to the charge of failing to attend court on March 13 and was sentenced on the three counts.

Judge Claudine MacDonald handed Wood a conditional discharge with one year of reporting probation on the three charges. Wood was fined a total of $300 in victim surcharges.

Wood committed the offences in Auburn on Jan. 10, 2017, and in Kentville on Jan. 3, 2018.

Probation offence

Angus Bruce Davidson, 45, of Forest Hill, has been fined and sentenced to probation for failing to comply with probation by failing to abstain from the use, consumption and possession of alcohol or non-prescribed drugs.

Davidson was found guilty of the charge on Nov. 22, 2017, and the matter was adjourned to allow time for a pre-sentence report to be updated and for sentencing.

On March 13, Judge Claudine MacDonald fined Davidson a total of $65 and sentenced him to nine months of reporting probation.

Davidson committed the offence in Forest Hill on May 13, 2017.

Undertaking offence

Alexander Samuel Szielasko, 26, of Kentville, has been handed a conditional discharge with probation for failing to comply with his undertaking.

Szielasko changed his plea to guilty on March 6 and the matter was adjourned to March 14 for sentencing. Judge Alan Tufts handed Szielasko a conditional discharge with six months of probation, including a $300 charitable donation.

Szielasko committed the offence in Kentville on July 15, 2017.
