Firearm, drug offences
Kyle Michael Joseph Markle, 22, of North Kentville, has been sentenced to jail time for several firearm offences and has been fined for two counts of drug possession and a charge of failing to comply with his recognizance.
Markle was originally charged with possessing cocaine for the purpose of trafficking and possessing marijuana for the purpose of trafficking but pleaded guilty to the lesser, included offence of possession on each charge in March.
Markle also pleaded guilty to charges of possessing three unlicenced handguns; possessing eight unlicenced long guns, possessing a prohibited firearm with readily accessible ammunition without holding the necessary authorization or licence and possessing a firearm knowing that the serial number had been defaced. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.
On June 20, Judge Ronda Van Der Hoek sentenced Markle to six months in custody on each of the four firearm-related charges, to be served concurrently. The court imposed a 10-year firearm prohibition against Markle, a lifetime prohibition on restricted weapons and granted a forfeiture order for the three handguns.
Markle was fined $260 for possessing cocaine and was fined $130 for possessing marijuana. He was also sentenced to 12 months of probation on each of the drug charges, to be served concurrently.
Markle committed the offences in North Kentville on Oct. 5, 2017. Charges of possessing stolen handguns and breaking and entering a store in Canning and stealing firearms were withdrawn on June 20. Charges against a co-accused, Samantha Hope Collins, 20, of North Kentville, were dismissed.
Markle pleaded guilty to a charge of failing to comply with his recognizance on June 6. On June 20, he was fined $260. Markle committed this offence in Kentville on March 25.
Impaired care or control, drove while disqualified
Dax Wayne Sylvanus Henson, 46, of Canning, has been handed a curative conditional discharge with probation for having care or control of a motor vehicle while his ability to operate a vehicle was impaired by alcohol or a drug and has been fined for operating a motor vehicle while disqualified.
Henson changed his plea to guilty to the impaired charge in March. The court imposed a two-year driving prohibition against Henson with eligibility for the ignition interlock program after six months. Notice of increased penalty was served and the matter was adjourned to allow time for a pre-sentence report to be prepared and for a curative discharge application.
On June 21, Judge Alan Tufts handed Henson a conditional curative discharge with 18 months of probation. Henson committed the offence in Kentville on Aug. 22, 2017
Henson pleaded guilty on June 21 to a charge of operating a motor vehicle while disqualified. He was fined $650 and was sentenced to six months of reporting probation. Henson committed this offence in Kentville on April 12.
Breathalyser offence
Kimberly Diane Simmons, 37, of Coldbrook, has been fined for operating a motor vehicle while her blood alcohol level exceeded the legal limit.
Simmons pleaded guilty to the charge on June 19. Judge Ronda Van Der Hoek fined Simmons a total of $1,300 and imposed a one-year driving prohibition against her.
Simmons committed the offence in Hantsport on March 29. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Simmons gave breathalyser readings of 120 and 110.
Mischief, recognizance offence
Michael Joseph Frank, 42, of North Kentville has been fined for committing mischief by willfully damaging a door to a value not exceeding $5,000 and for failing to comply with his recognizance by failing to comply with a condition to have no direct or indirect contact or communication with an individual.
Frank pleaded guilty to the charges on June 19. Judge Alan Tufts fined Frank $247 on each charge, for a total of $494 in fines, and sentenced him to nine months of non-reporting probation.
Frank committed the offences in New Minas on May 15.
Conditional discharge for mischief
Aaron Paulson Elderkin, 29, of Greenwich, has been handed a conditional discharge with probation for committing mischief by willfully damaging an individual’s car mirror.
Elderkin changed his plea to guilty on June 18. Judge Alan Tufts handed Elderkin a conditional discharge with 12 months of probation. The matter of a standalone restitution order has been adjourned to June 28 to set the amount.
Elderkin committed the offence in Greenwich on Jan. 30, 2017. A charge of assault was dismissed on June 18 with the Crown offering no evidence.
