Jail time for various offences
Omar Orlando McIntosh, 31, of North Kentville, has been sentenced to jail time and probation for committing an assault causing bodily harm; uttering a threat to cause bodily harm or death, resisting a member of the Kentville Police Service engaged in the execution of his duty, failing to comply with probation and failing to attend court as directed by a judge.
McIntosh was originally charged with aggravated assault but pleaded guilty to the included offence of assault causing bodily harm on July 10. McIntosh pleaded guilty or changed his pleas to guilty to the other four charges on July 10.
Judge Ronda Van Der Hoek sentenced McIntosh to six months in custody on the charges of assault causing bodily harm and uttering a death threat. McIntosh was granted a 28-day credit for 19 days spent remanded in custody, leaving 156 days left to serve.
McIntosh was sentenced to 18 months of reporting probation and the court imposed a 10-year firearm prohibition against him. The court granted a primary DNA order in relation to the assault causing bodily harm charge.
McIntosh was sentenced to one day in custody deemed served on each of the remaining three charges, concurrently.
McIntosh committed the offences in Kentville on July 23, 2015, and on June 23, 2016. Charges of failing to comply with his recognizance, using a weapon – a hammer – in committing an assault, unlawful confinement and attempting to choke an individual with intent to enable himself to commit an indicatable offence were withdrawn or dismissed on July 10.
Evaded police, recognizance offence
Adam Devon Best, 33, of Centreville, has been handed a suspended sentence with probation for failing to stop his vehicle as soon as was reasonable in the circumstances in order to evade police and for failing to comply with his recognizance.
Best changed his pleas to guilty on July 8. Judge Ronda Van Der Hoek handed Best a suspended sentence with nine months of reporting probation on the two charges. The court imposed a nine-month driving prohibition against Best in relation to the charge of failing to stop his vehicle in order to evade police and ordered him to complete 20 hours of community service work in relation to the recognizance charge.
Best committed the offences in Kentville on Jan. 14. A charge of resisting a member of the Kentville Police Service engaged in the execution of his duty was dismissed on July 8 with the Crown offering no evidence.
Sentenced on drug charges
Steven Wayne Legge, 46, of Greenwich, has been handed a conditional sentence order with daily curfew and sentenced to probation for unlawfully possessing cannabis marijuana for the purpose of trafficking and unlawfully producing cannabis marijuana.
Legge changed his pleas to guilty on Nov. 21, 2018, and the matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.
On July 11, Judge Christopher Manning handed Legge a three-month conditional sentence order with daily curfew from 10 p.m. to 5:30 a.m. for the entire time - to be followed by nine months of probation - on the possession for the purpose of trafficking charge.
The court imposed a 10-year, three-month firearms prohibition against Legge and granted a forfeiture order for offence-related property.
Legge was fined $1,000 for unlawfully producing cannabis marijuana and the court granted a forfeiture order for offence-related property.
Legge committed the offences in Greenwich on June 16, 2017.
Failed to stop for police
Morgan Ross, 25, of Kingston, has been fined for failing to stop his vehicle as soon as was reasonable in the circumstances while being pursued by a police officer.
Ross pleaded guilty to this charge and to a charge of operating a conveyance while prohibited from doing so on July 2.
On July 11, the court consented to Ross withdrawing his guilty plea to the charge of operating a conveyance while prohibited from doing so. Ross was fined $500 for failing to stop his vehicle as soon as was reasonable in the circumstances while being pursued by a police officer.
Ross committed the offence in Avonport on March 7. The charge of operating a conveyance while prohibited and a charge of dangerous driving were withdrawn on July 11.
Impaired driving
A Greenwood man has been fined following an impaired driving conviction.
Matthew James Robert, 29, was sentenced in Kentville provincial court July 4.
He entered a guilty plea to one count of impaired operation of a motor vehicle.
Robert was handed a two-year driving prohibition, instructed to complete a one-year period of probation, and ordered to pay a $2,000 fine.
The offence occurred in Greenwood on Oct. 6, 2018. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Robert’s blood alcohol readings were not available.
Conditional discharge for assault
A Kentville resident has been ordered to settle one count of assault with a weapon by means of a conditional discharge with probation.
Narindar Kaur Hamilton, 59, pleaded guilty to the charge stemming from an incident in Kentville on Feb. 14.
Hamilton was sentenced to a conditional discharge with nine months of probation in Kentville provincial court on July 4.
