RCMP officer found guilty of impaired driving, refusing breathalyser in Auburn

An RCMP officer has been found guilty of impaired driving and refusing the breathalyser.

KENTVILLE, NS - An RCMP officer has been found guilty of impaired driving and refusing the breathalyser.

Cpl. Scott Frederick MacMillan, 48, of Kentville, was present in Kentville provincial court on June 27 when a decision was rendered by Judge Ronda Van Der Hoek following a trial. MacMillan had pleaded not guilty to the charges.

He was found guilty of operating a motor vehicle while his ability to do so was impaired by alcohol and refusing to comply with a demand made to him by a police officer to provide samples of his breath for analysis to determine the concentration, if any, of alcohol in his blood.

MacMillan was fined $1,300 on each charge, for a total of $2,600 in fines, and the court imposed a one-year driving prohibition against MacMillan on each charge, to be served concurrently.

A member of the Kings District RCMP initiated a traffic stop on a vehicle on Highway 1 in Auburn on Dec. 24, 2016. The driver was MacMillan, an off-duty member of the RCMP. On Jan. 4, 2017, MacMillan was charged with the two offences.

MacMillan, a member of the RCMP Southwest Nova Major Crimes Unit, had 26 years of service at the time of the offences. He was placed on administrative leave as the RCMP initiated an internal Code of Conduct investigation in relation to MacMillan’s conduct in January 2017.
