Custody for conditional sentence breach
Darroll Murray Atwell, 40, of Wolfville, has been sentenced to time in custody for breaching his conditional sentence order.
Atwell was sentenced on April 26 to a six-month conditional sentence order with daily curfew from 10 p.m. to 5 a.m., to be followed by 12 months of probation. He had pleaded guilty in March to charges of stealing two cash boxes from Rogers Telecommunications; two counts of possessing stolen property valued at less than $5,000, possessing a stolen Canadian Tire bank credit card and possessing a stolen Scotiabank debit card.
Atwell appeared in Kentville provincial court on Aug. 29 on an allegation that he breached the conditional sentence order. The court found that he had been in possession of alcohol in Lockhartville on Aug. 7, which constituted a breach, and that he had failed to keep the peace and to be of good behaviour.
Judge Christopher Manning suspended Atwell’s conditional sentence for 10 days, which Atwell will spend in custody. The conditional sentence will resume under the same conditions as before once the 10 days is served.
Charges of failing to comply with a conditional sentence order and having care or control of a motor vehicle while his ability to operate was impaired by alcohol or a drug were dismissed on Aug. 29 with the Crown offering no evidence.
Unlawfully produced marijuana
Brian Wilfred Fiander, 59, of Greenwood, has been fined and sentenced to probation for unlawfully producing cannabis marijuana.
Fiander pleaded guilty to the charge on Aug. 28. Judge Alan Tufts fined Fiander a total of $650 and sentenced him to six months of reporting probation. The court imposed a 10-year firearms prohibition against Fiander and granted a forfeiture order for property seized in relation to the Controlled Drugs and Substances Act charge with consent.
Fiander committed the offence in Greenwood on May 11.
Breathalyser offence
Shiloh Talia Morris, 22, of Greenwood, has been fined for operating a motor vehicle while her blood alcohol level exceeded the legal limit.
Morris pleaded guilty to the charge on Aug. 28. Judge Alan Tufts fined Morris a total of $1,300 and imposed a one-year driving prohibition against her.
Morris committed the offence in Coldbrook on May 6. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Morris gave breathalyser readings of 130 and 130.
Breathalyser offence
Alexander Hudson Anderson, 18, of Berwick, has been fined for having care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.
Anderson pleaded guilty to the charge on Aug. 28. Judge Alan Tufts fined Anderson a total of $1,300 and imposed a one-year driving prohibition against him.
Anderson committed the offence in Welsford on June 30. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Anderson gave breathalyser readings of 110 and 100.
Probation, undertaking offences
Scott Samuel Cowell, 34, of Waterville, has been fined for failing to comply with probation and three counts of failing to comply with his undertaking.
Cowell pleaded guilty to the charges on Aug. 28. Judge Alan Tufts fined Cowell $20 on each of the four counts, for a total of $80 in fines.
Cowell committed the offences in Waterville on April 30, May 2 and May 22 and in Cambridge on Aug. 15. A charge of stealing property of a value not exceeding $5,000 from Joanne’s Marketplace was withdrawn on Aug. 28.
Peace bond offence
Darren Phillip Rouse, 52, of North Kentville, has been sentenced to time deemed served and fined for breaching a peace bond recognizance.
Rouse changed his plea to guilty on Aug. 29. Judge Christopher Manning sentenced Rouse to one day in custody deemed served and fined him a total of $13.
Rouse committed the offence in North Kentville on June 18. A charge of resisting two police officers engaged in the execution of their duty was dismissed at the request of the Crown on Aug. 20. Charges of uttering a death threat and two counts of failing to comply with his recognizance by failing to keep the peace and to be of good behaviour were dismissed on Aug. 29 with the Crown offering no evidence.
Undertaking offence
Alexander Gerd Angermann, 50, of Kentville, has been fined for failing to comply with his undertaking by failing to abstain from consuming alcohol.
Angermann pleaded guilty to the charge on Aug. 28. Judge Alan Tufts fined him a total of $390.
Angermann committed the offence in Kentville on July 7.
