This is the latest court report for Kings and West Hants counties.

Stole from store, recognizance offences

Dale Stephen MacTavish, 29, of no fixed address, has been sentenced for stealing property valued at less than $5,000 from Lawton’s Drugs and two counts of failing to comply with his recognizance.

MacTavish pleaded guilty to the charges on April 10. The matters were adjourned to June 11 to allow time for a pre-sentence report to be updated and for sentencing.

Judge Ronda Van Der Hoek sentenced MacTavish to a total of 12 months of probation on the three charges, including 15 hours of community service work on the theft charge and 15 hours of community service work on the second count of failing to comply with his recognizance.

MacTavish committed the offences in Kentville on March 14 and 15. Another count of failing to comply with his recognizance and a charge of failing to comply with his undertaking were withdrawn.

Failed to report, make restitution

Cathy Lynn Moors, 48, of Coldbrook, has been sentenced to probation and fined for failing to comply with probation by failing to report as directed and for failing to make restitution to Milne Court Petro Canada as directed by the court.

Moors changed her pleas to guilty to both counts in April and the matters were adjourned to June 11 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Ronda Van Der Hoek sentenced Moors to a total of 18 months of probation and fined her a total of $57.50. Moors was also ordered to make restitution in the amount of $2,447 to Milne Court Petro Canada, to be paid at a rate of $150 per month.

Moors committed the offences in Kings County between March 21 and July 19, 2017, and in Kentville between July 18, 2016, and July 15, 2017.

Produced marijuana, possessed resin

Daniel Lee Toney, 31, of Cambridge, Kings County, has been sentenced to probation for unlawfully producing cannabis marijuana and unlawfully possessing cannabis resin.

Toney changed his pleas to guilty to the two charges on June 11. Judge Ronda Van Der Hoek sentenced Toney to 12 months of probation and fined him a total of $400 in victim surcharges on the two counts. The court imposed a 10-year firearms prohibition against Toney and granted a forfeiture order for items seized. Toney will also participate in a healing circle through the Mi’kmaq Legal Support Network.

Toney committed the offences in Cambridge on June 7, 2017. A charge of unlawfully possessing marijuana for the purpose of trafficking was dismissed on June 11 with the Crown offering no evidence.

Breathalyser offence

Gregory Ernest McCarthy, 47, of Three Mile Plains, has been fined and sentenced to probation for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

McCarthy pleaded guilty to the charge in March. The court imposed an 18-month driving prohibition against McCarthy and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. On June 12, Judge Alan Tufts fined McCarthy a total of $2,600 and sentenced him to 18 months of probation.

McCarthy committed the offence in Martock on Jan. 26. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. McCarthy gave breathalyser readings of 230 and 230.

Warrant issued after court no show

A warrant of remand has been issued by the Kentville provincial court for Merissa Eddy, 18.

Eddy, who has no fixed address, was due to appear in court June 7 and again 8 to face seven charges, including allegedly threatening to kill two people, allegedly threatening to kill them with a weapon, and the alleged possession of a dangerous weapon.

Eddy is alleged to have uttered the threats and to have had the weapon in her possession May 29 in Cambridge.

She also faces charges for allegedly breaching her probation and recognizance.

No contact order after assault

Elmore Rolfe, 64, of Windsor Forks, has been handed a conditional discharge after he was found guilty of assault.

Rolfe appeared in Windsor provincial court June 8 where he was handed his sentence and ordered to keep the peace and to also report to his probation officer as directed.

He was also ordered to take any counselling mandated by his officer to resolve issues of a personal nature.

He is to have no contact with the female he assaulted except under strict terms.

The assault took place April 25, 2018.

Fines and peace bond

Newport resident Tracey Leanne Beaver has been handed $100 in fines and a peace bond order after being found guilty of disorderly behaviour.

Beaver, 43, appeared in Windsor provincial court June 8 to receive her sentence. Two other charges were dropped.

The charges stemmed from a January 28 incident in Brooklyn.
