Kentville man sentenced to jail time for possessing child pornography videos

KENTVILLE, NS - A Kentville man will serve time in custody after pleading guilty to possessing child pornography videos.

Michael Arthur Miller, 60, changed his plea to guilty to the possession charge in May. The matter was adjourned to Oct. 16 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Alan Tufts sentenced Miller to 90 days in custody and two years of reporting probation. The court granted a forfeiture order for a hard drive and lap top computer. A primary DNA order was granted and the court imposed a 10-year Sex Offender Information Registration Act (SOIRA) order.

The court also granted a prohibition order under Section 161 (1) of the Criminal Code. Miller shall not attend anywhere where children under age 16 are present or can reasonably be expected to be present, including public parks, swimming areas, community centres, daycare centres, school grounds or playgrounds.

Miller shall not seek, obtain or continue any employment – whether or not the employment is remunerated – or become or be a volunteer in any capacity that involves being in a position of trust or authority towards persons under the age of 16.

Miller shall not have any contact, including communication by any means, with a person under age 16 unless Miller does so under the supervision of a person the court considers appropriate.

Miller shall not use the Internet or other digital network for 10 years unless he does so in accordance with conditions set by the court. These include paying bills online, when employed and doing online employment duties and while supervised by an adult over 19 years of age.

Miller committed the offence in Kentville on July 9, 2015. A charge of making available child pornography in Kentville on April 27, 2015, was dismissed.

The Kings District RCMP and Kentville Police Service assisted the provincial Internet Child Exploitation (ICE) Unit in executing a search warrant at a Kentville home on July 9, 2015. Miller was arrested without incident and charged.
