High readings, breach

The court has fined a Dartmouth man for driving with high blood-alcohol readings and breaching a court order.

Jonathan Parker Furey, 22, pleaded guilty in Windsor provincial court Friday, Jan. 12 to driving while his blood-alcohol level exceeded the legal limit, and to failing to comply with a court undertaking not to consume alcoholic beverages.

Judge Alan Tufts fined Furey $850 plus a $127.50 victim surcharge, or 17 days in custody on willful default, for the blood-alcohol readings. He also prohibited Furey from driving in Canada for a year, a period the Nova Scotia Registry of Motor Vehicles will at least match.

For the breach, Tufts fined Furey $150 plus a $22.50 victim surcharge, or three days in custody upon willful default.

Furey committed the offenses in Windsor Sept. 3 when police found that his blood-alcohol readings were 190 and 180 milligrams of alcohol per 100 millilitres of blood.

The legal limit is 80 mg/100 ml. The Criminal Code of Canada provides for increased penalties for those breathalyzer offenses in which readings exceed 160 mg/100 ml.



Fined for blood-alcohol levels

Upper Falmouth resident Alfred Terry Payzant, 37, pleaded guilty Tuesday, Jan. 16 to having care and control of a vehicle while his blood-alcohol level exceeded the 80 mg/100 ml limit.

Judge Claudine MacDonald fined Payzant $900 plus a $135 victim surcharge, or 18 days in custody on willful default. She also prohibited the accused from driving in Canada for a year, which will be at least matched by the Registry of Motor Vehicles.

Payzant committed the offense in Windsor Aug. 5 when police found he had blood-alcohol readings of 190 and 170 mg/100 ml.



Assault results in probation

Judge MacDonald suspended sentencing on Three Mile Plains resident Marc Eugene Joseph Renaud, 42, for assault and imposed a term of 15 months of reporting probation on him.

Conditions include Renaud taking assessment, counselling or treatment recommended by Corrections officials.

Renaud committed the assault in Three Mile Plains Oct. 22. He pleaded guilty to the charge Dec. 5.



Breached undertaking

Windsor resident Jeffery Russell MacUmber, 38, pleaded guilty Monday, Jan. 15 to failing to comply with a court undertaking.

Judge Claudine MacDonald fined MacUmber $200 plus a $30 victim surcharge, or four days in custody, for the breach.

MacUmber committed the breach in Windsor Nov. 24 when he failed to comply with an undertaking condition not to consume alcoholic beverages.



Short sentence for breach

Judge MacDonald sentenced Leminster resident Noble James Ernest Hebb, 39, Jan. 16 to one day deemed served by his court appearance for failing to comply with a probation order.

Hebb committed the breach in Windsor Aug. 19 when he failed to comply with a condition that he not possess and/or consume alcoholic beverages.



Show cause hearing adjourned

The court has adjourned the show cause hearing of a 27-year-old man of no fixed address on several charges related to incidents in Windsor and other communities on and about Jan. 11.

The accused appeared in court Jan. 16 to face charges of possession of illegally obtained property valued at more than $5,000; theft of movies valued at less than $5,000; possession of a knife for a purpose dangerous to the public; threatening to cause bodily harm; and two counts of theft of gasoline valued at less than $5,000.

The accused has consented to remand until the show cause, which is scheduled for Jan. 23.

The stolen property possession, movie theft, weapon possession, and threat are alleged to have taken place in Windsor Jan. 11; one gas theft, Three Mile Plains, Jan. 10 and the second, Falmouth, Jan. 12.

The accused has been remanded since Jan. 12.
