Jailed for stolen property, resisting



A Kentville man has received a jail term for possession of stolen property and for resisting a police officer in the execution of duties.

Chrisitopher Andrew Lee Lombardo, 28, pleaded guilty to the charges in Kentville provincial court Monday, Nov. 6.

Judge Alan Tufts sentenced Lombardo to six months in custody for each of the offenses, to be served concurrently with each other.

Lombardo committed the offenses in Kentville Oct. 23.



Terminated conditional sentence



A New Minas man is serving a term in jail after failing to comply with his conditional sentence conditions.

Appearing in Kentville provincial court Friday, Nov. 3, Craig Darcy Spencer, 36, admitted to breaching his conditional sentence of Oct. 18.

Judge Alan Tufts terminated the order, meaning that Spencer will serve the rest of his sentence in custody.

The original order was for three months, the first month of it in the form of house arrest. Spencer breached it Oct. 27 and 28 by not being at home when corrections officials called.

The original sentence was for having care and control of a vehicle while his blood-alcohol readings exceeded the legal limit of 80 milligrams per alcohol per 100 millilitres of blood. His readings were 230 and 220 mg/100 ml and he breached a probation order, both June 29.



High readings, left scene



Centreville resident Bruce Wayne Butler, 47, pleaded guilty Tuesday, Nov. 7 to having care and control of a vehicle while his blood-alcohol readings exceeded the legal limit, and to failing to stop immediately at the scene of an accident in which he was involved, contrary to the Nova Scotia Motor Vehicles Act.

Judge Tufts fined Butler $1,200 plus a $180 victim surcharge, or 24 days in custody on willful default, and imposed a term of reporting probation for the breathalyzer offense.

The probationary conditions include a ban on Butler possessing and consuming alcoholic beverages and from driving. He must also take any recommended assessments, counselling or treatment.

The judge also prohibited Butler from driving in Canada for 18 months, a period the Nova Scotia Registry of Motor Vehicles will at least match for driving in the province.

Tufts also fined Butler $100 for the Motor Vehicle Act offense.

Butler committed the offenses in Kentville Oct. 8 when police found that his blood-alcohol readings were 200 and 190 milligrams of alcohol per 100 millilitres of blood. The legal limit is 80 mg/100 ml. The Criminal Code of Canada allows for heavier penalties in those breathalyzer cases in which the blood-alcohol readings exceed 160 mg/100 ml, and/or for other aggravating circumstances.



Fine, probation for high readings



Wolfville resident Edward Daniel Hicklin, 22, pleaded guilty Nov. 6 to driving while his blood alcohol level exceeded the 80 mg/100 ml limit.

Judge Tufts fined Hicklin $800, or 14 days in custody on willful default, and imposed a term of six months of non-reporting probation.

The probationary conditions included Hicklin not possessing or consuming alcoholic beverages.

Tufts also prohibited Hicklin from driving in Canada for a year, a period the Nova Scotia Registry of Motor Vehicles will at least match for driving in the province.

Hicklin committed the offense in Wolfville Sept. 23 when police found he had blood-alcohol readings of 220 and 200 mg/100 ml.



Fined for blood-alcohol readings



Wolfville resident Harold Maurice Kelly, 47, pleaded guilty to driving while his blood-alcohol level exceeded the 80 mg/100 ml legal limit.

Judge Tufts fined Kelly $750 plus a $112.50 victim surcharge, or 15 days in custody on willful default, and prohibited him from driving in Canada for a year.

The Registry of Motor Vehicles will ban Kelly from driving in the province for at least as long.

Kelly committed the offense in Greenwich Sept. 29 when police found he had blood-alcohol readings of 160 and 150 mg/100 ml.



Failed to drive carefully, prudently



Waterville resident Skylar Andrew Hart, 18, pleaded guilty Nov. 6 to failing to drive in a careful and prudent manner, contrary to the Nova Scotia Motor Vehicles Act.

Judge Claudine MacDonald fined Hart $300 plus a $45 victim surcharge and suspended his driver’s license for six months: from Nov. 6, 2006 to May 6, 2007.

Hart committed the offense in Coldbrook April 26.



Drove while privilege revoked



Counsel for Wolfville resident Juan Ramirez-Marin, 32, pleaded guilty on his behalf Nov. 7 to driving while his privilege of obtaining a driver’s license was revoked, contrary to the Motor Vehicles Act.

Judge Tufts fined Ramirez-Marin $500 plus a $75 victim surcharge. Ramirez-Marin committed the offense in Wolfville March 5.



Fined for liquor store theft



Kentville resident Matthew Arthur Lightfoot, 23, pleaded guilty Nov. 6 to theft of property valued at less than $5,000 from the New Minas Nova Scotia Liquor Commission.

Judge Tufts fined Lightfoot $150 plus a $22.50 victim surcharge, or three days in custody on willful default. Lightfoot committed the theft July 3.



Pleaded guilty to luring



A 51-year-old Greenwood man pleaded guilty Nov. 6 to two counts of unlawfully using a computer to communicate with a person believed to be under 14 years of age for the purpose of facilitating an indecent act. The two counts involved two separate children.

The accused will return to court Dec. 19 for sentencing pending a pre-sentence report.

He committed the offenses in Greenwood May 31.
