House arrest for offenses
East Walton resident Leslie Weldon Card, 32, pleaded guilty in Windsor provincial court Tuesday, Oct. 10, to unlawful production of cannabis marijuana, a Schedule II drug under the Controlled Drugs and Substances Act, fraudulently consuming electrical service and possession of a prohibited weapon, a sawed-off shotgun.
Judge Claudine MacDonald imposed a conditional sentence order, to be followed by one year reporting probation, on Card. The sentence includes three months’ house arrest, with the usual exceptions for work, education appointments and emergencies. The remainder of the sentence is to be in the form of a curfew.
MacDonald also prohibited him from possession firearms for 10 years and six months and restricted firearms for life. She also forfeited all materials involved in the offenses to the Crown.
Card committed the offenses in East Walton May 19.
Probation for school break-in
Vaughan resident Norman Harris Boutilier, 19, pleaded guilty Oct. 10 to break and entry to a school and committing an indictable offense of theft therein.
Judge MacDonald suspended sentencing on Boutilier for the break-in and imposed a term of 18 months probation and ordered him to perform 100 hours of community service work.
The probation conditions include Boutilier taking recommended assessment, counselling or treatment, and refraining from consuming alcoholic beverages or non-medically prescribed drugs.
Boutilier committed the break-in at Windsor Forks Feb 21.
Probation for assault
Judge MacDonald suspended sentencing Oct. 10 on Robert Dawe Gibson, 21, Windsor, for assault and imposed a term of eight months reporting probation on him.
Gibson committed the assault in Windsor March 14 and pleaded guilty April 25.
Fine for care and control
Judge MacDonald found Dartmouth resident Meredith Drake McCulloch, 43, guilty Oct. 10 of having care and control of a vehicle while her blood-alcohol level exceeded the legal limit.
MacDonald fined McCulloch $1,000 plus a $150 victim surcharge, or 20 days in custody on willful default. She also prohibited McCulloch from driving in Canada for a year, a period that the Nova Scotia Registry of Motor Vehicles will at least match in banning the accused from driving in the province.
McCulloch committed the offense in Greenfield, Hants County, March 11, when police found that she had readings of 120 and 130 milligrams of alcohol in 100 millilitres of blood. The legal limit is 80 mg/100 ml.
Probation for breach
Mill Section resident Frederick Stewart Davis, 20, pleaded guilty Oct. 20 to failing to comply with a court recognizance to keep the peace and be of good behaviour. Judge MacDonald suspended sentencing and imposed a term of one year non-reporting probation on him.
Davis committed the breach in Mill Section June 23.
Child porn suspect remanded
The suspect in the child porn and sexual assault and sexual touching cases allegedly involving a boy and a girl under 14 was scheduled to be back in court this week. He will seek new counsel.
In Windsor provincial court, Friday, Oct. 6, Judge Alan Tufts ordered the 28-year-old Windsor man to return to court Tuesday, Oct. 17 for a show cause hearing and to get new counsel. The accused consented to remand until the court appearance.
He has been remanded since his first appearance in court on the matters Aug. 29. He faces two charges of sexual assault involving a girl and a boy, four sexual touching -related charges involving the same boy and girl, and making child pornography and possessing child pornography.
The offences are alleged to have taken place between Feb. 1 and Aug. 25 this year.
