Fine, probation for impaired driving

The court has fined an Upper Rawdon man and imposed a term of probation on him for driving while impaired last spring.

Shawn Robert Elliott, 41, pleaded guilty in Windsor provincial court Monday, Aug. 11, to driving while impaired by a drug or alcohol.

Judge Claudine MacDonald fined Elliott $1,200 plus a $180 victim surcharge, or 21 days in custody on willful default.

The judge also imposed a term of 18 months probation on Elliott. Probation conditions include that Elliott refrain from possessing or consuming alcoholic beverages; take any recommended assessment, counselling or treatment; and that he stay away from any establishment the primary business of which is the sale of alcoholic beverages.

Elliott committed the offense in Upper Rawdon March 26 and pleaded guilty to the charge June 17.

At the time of the plea, the court prohibited Elliott from driving in Canada for a year. The Nova Scotia Registry of Motor Vehicles will ban him from driving in the province for at least a year.

The crown withdrew a breathalyzer charge.

Phone threat results in probation

Windsor resident Jeff Scott Gray, 36, pleaded guilty Tuesday, Aug. 12, to uttering a threat by telephone to cause death or bodily harm to a person.

Judge MacDonald suspended sentencing on Gray for the conviction and imposed a term of 18 months reporting probation on him.

Probation conditions include that Gray take any recommended assessment, counselling or treatment; refrain from possessing or consuming alcoholic beverages or non-medically prescribed drugs; and have no contact or communications with the victim.

The judge also ordered Gray to provide a DNA sample to be kept on record by corrections officials.

Gray uttered the threat in Newport Station, Nov. 12, 2007.

Probation for firearms offense

Falmouth resident Gerald Reid Allen, 43, pleaded guilty Aug. 11 to leaving an unsecured firearm in a vehicle.

Judge MacDonald suspended sentencing on Allen for the conviction and imposed a term of one year reporting probation on him.

Probation conditions include Allen refrain from possession or consuming alcoholic beverages or non-medically prescribed drugs; take any recommended assessment, counselling or treatment; and not possess firearms.

The judge also forfeited the firearm involved in the offense.

Allen omitted the offense in Falmouth Nov. 12, 2007.

Granted conditional discharge

Judge MacDonald granted a conditional discharge Aug. 11 to Mosherville resident Scott Kerry Hood, 22, on a charge of assault. The discharge is pending 12 months non-reporting probation, a condition of which is for Hood not to have contact with a specific person.

The charge resulted from an incident in Mosherville May 28, 2007. Hood pleaded guilty to the charge Aug. 11.

Convicted automatically

Judge MacDonald, Aug. 11, automatically convicted Clarksville resident Billy Lee Spence, 33, of driving between 16 and 30 kilometres per hour in excess of the posted speed limit, contrary to the Nova Scotia Motor Vehicles Act (MVA).

The judge fined Spence $150 plus a $22.50 victim surcharge and $107 costs, and suspended his driver’s license between Aug. 18 and 25.

Spence had pleaded not guilty to the charge may 27, but did not appear for his scheduled trial Aug. 11.

Police laid the charge near Exit 3 on Highway 101 Feb. 26.
