Invoked ignition interlock clause

Forest Glade, Annapolis County resident Norman Franklyn Goucher, 38, pleaded guilty June 23 to having care and control of a vehicle while his blood/alcohol readings exceeded the 80-mg/100-ml level.

Judge Claudine MacDonald fined Goucher $850 plus a $127.50 victim surcharge, or 15 days in custody on willful default, and imposed a Canada-wide, one-year driving ban on him, which will at least be matched by the province.

MacDonald also allowed for an ignition interlock device to be installed in Goucher’s vehicle after the first three months of the bans.

Goucher committed the offense in Greenwood April 27 when police found he had blood-alcohol readings of 130 and 130 mg/ 100 ml.

Low but illegal readings

Greenwood resident Cory Lance Gargin, 31, pleaded guilty June 23 to driving while his blood/alcohol readings exceeded the 80-mg/100-ml limit.

Judge MacDonald fined Gargin $800 plus a $120 victim surcharge. She also prohibited him from driving in Canada for a year, a ban the province will at least match.

The judge provided for an ignition interlock device to be installed in Gargin’s vehicles after the first three months of the prohibitions.

Gargin committed the offense in Greenwood April 20 when police found he had blood/alcohol readings of 100 and 90-mg/100-ml of blood.

Failed probation

Kentville resident Dax Wayne Henson, 36, pleaded guilty June 23 to failing to comply with a probation order.

Judge MacDonald fined Henson $300 plus a $45 victim surcharge, or five days in custody on willful default. Henson committed the breach April 29.

MVA fines ad up

Torbrook Mines, Annapolis County resident Ainsley Richard Crouse, 45, pleaded guilty June 23 to driving without the required liability insurance, driving while his privilege of obtaining a license was revoked, driving an unregistered vehicle, and driving without a valid inspection sticker, all contrary to the Nova Scotia Motor Vehicles Act (MVA).

Judge MacDonald fined Crouse $1,000 plus a $150 victim surcharge, or 30 days in custody on willful default, for the insurance offense; $500 plus a $75 victim surcharge, or 30 days, for the revoked privilege; and $100 plus $15 victim surcharge, or 30 days, each for the registration and inspection sticker offenses.

The 30-day defaults will be served concurrently. Crouse committed the offenses in Kingston May 2.

Drove without insurance, revoked

Kentville resident Johnny Albert Spencer, 50, pleaded guilty June 23 to driving without the required liability insurance and to driving while his privilege of obtaining a license was revoked, both contrary to the MVA.

Judge MacDonald fined Spencer $1,000 plus a $150 victim surcharge and $100 in costs for the insurance offense, and $500 plus a $75 victim surcharge for the revoked privilege.

Spencer committed the offenses on Belcher Street May 23.

Drove while privilege revoked

Kentville resident Carman Douglas Young, 33, pleaded guilty June 23 to driving while his privilege of obtaining a license was revoked, contrary to the MVA.

Judge MacDonald fined Young $500 plus a $75 victim surcharge and $100 in costs. Young committed the offense on Highway 12, North Alton May 16.

Changed CSO conditions

North Kentville resident Tona Lisa Mills, 36, recently admitted in Digby provincial court to breaching her conditional sentence order (CSO).

Judge Jean-Louis Batiot changed the condition to optional. The nine-month CSO was the sentence for a Jan. 9 probation breach in Greenwood and a Jan. 16 assault in Middleton.

Mills committed the breach in Kentville March 20 when she failed to confine herself at home.

Granted conditional discharge

Judge Alan Tufts granted a conditional discharge to Kentville resident Shane Kyle Greene, 18, June 25 on charges of assault and failing to comply with a recognizance order. The discharge is pending nine months’ probation, including a $150 charitable donation to The Red Door.

The charges stemmed from an incident in Kentville March 31. Greene pleaded guilty to the charges May 20.

Convicted automatically

Judge MacDonald convicted automatically Halifax resident Matthew Gordon Caldwell, 27, June 23 of illegal possession of liquor, contrary to the Nova Scotia Liquor Control Act (LCA).

The judge fined Caldwell $300 plus a $45 victim surcharge and $107 in costs. Police laid the charge in north Kentville May 18.
