Jailed for refusal, breach

The court has sentenced a Kentville man to jail for refusing to provide a breath sample for blood-alcohol analysis and for a probation breach.

Cecil James Dominey, 26, pleaded guilty to both charges in Kentville provincial court Monday, June 2.

Judge Alan Tufts sentenced Dominey to 30 days in custody for the refusal and to 15 days for the breach. The sentences are to be served consecutively. They will be followed by nine months of reporting probation.

Probationary conditions include Dominey taking any recommended assessment, counselling or treatment and refraining from possessing or consuming alcoholic beverages.

The judge also prohibited Dominey from driving in Canada for two years for the refusal. The Nova Scotia Registry of Motor Vehicles will ban Dominey from driving in the province for at least two years.

Dominey committed the refusal and breach in Kentville April 12.

Fined for breathalyzer offense

Halifax resident Jason Alan T. Johnson pleaded guilty June 2 to driving while his blood-alcohol level exceeded the legal limit.

Judge Tufts fined Johnson $750 plus a $12.50 victim surcharge, or 13 days in custody on willful default, and prohibited him from driving in Canada for a year. The Registry of Motor Vehicles will at least match the driving ban.

Johnson committed the offense in Wolfville Oct. 8, 2007 when police found he had blood-alcohol readings of 140 and 120 milligrams of alcohol per 100 milligrams of blood. The legal limit is 80 mg/100 ml.

Probation for breaches

Berwick resident Isaac William Hatt, 24, pleaded guilty June 2 to two counts of failing to comply with probation orders.

Judge Tufts suspended sentencing on Hatt for the convictions and imposed a term of six months’ reporting probation on him. Probationary conditions include that Hatt pay $494.50 in restitution.

Hatt committed the first breach in Kentville between April 28 to Aug. 23, 2005 when he failed to report to Corrections officials as ordered. He committed the second breach between April 21, 2005 and Jan. 21, 2006, when he failed to pay restitution.

Fines for mischief, breach

Halifax resident Anthony Michael Stokes, 34, pleaded guilty June 2 to committing mischief by providing police with a false name and to failing to comply with a probation order.

Judge Tufts fined Stokes $150 plus a $22.50 victim surcharge, or two days in custody on willful default, for each of the offenses.

Stokes committed the breach and mischief in Kentville May 31.

Drove while license revoked

New Minas resident George Loran Lewis, 37, pleaded guilty June 2 to driving while his license was revoked, contrary to the Nova Scotia Motor Vehicles Act (MVA).

Judge Tufts fined Lewis $1,000 or 30 days in custody on willful default. Lewis committed the offense in New Minas June 2.

Failed to drive carefully, prudently

Kingston resident Stefan Robert Plazier, 35, pleaded guilty June 2 to failing to drive in a prudent and careful manner, contrary to the MVA. Judge Tufts fined Plazier $100.

Plazier committed the offense in Greenwood April 29.

Granted conditional discharge

Judge Tufts granted a conditional discharge June 2 to Kingston resident Timothy John Parsons, 27, for property damage at a billiards hall. The discharge is pending six months’ reporting probation and payment of a $200 charitable donation to the Red Door.

Probationary conditions include Parsons taking any recommended assessment, counselling or treatment.

The charge stemmed from an incident in Greenwood June 17, 2007. Parsons pleaded guilty to the charge June 2.
