Refusal, breach, possession

The court has fined a Three Mile Plains man for a number of offenses, including refusing a breathalyzer test, breaching probation and possessing marijuana.

Steven Wade Lantz, 19, pleaded guilty in Windsor provincial court Tuesday, Dec. 9 to refusing to provide a breath sample for blood-alcohol analysis; failing to comply with a probation condition to refrain from possessing or consuming alcoholic beverages or non-medically prescribed drugs; and possessing cannabis marijuana, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA).

For the refusal, Judge Alan Tufts fined Lantz $1,000 plus a $150 victim surcharge, or 17 days in custody on willful default, and prohibited him from driving in Canada for a year.

The Nova Scotia Registry of Motor Vehicles will ban Lantz from driving in the province for at least a year.

Judge Tufts fined Lantz $200 plus a $30 victim surcharge, or three days in custody, for the probation breach, and $300 plus a $45 victim surcharge, or five days, for the CDSA offense.

Lantz committed the offenses in Windsor Sept. 6.



Probation for assaults

Judge Claudine MacDonald suspended sentencing Friday, Dec. 5 on Mount Uniacke resident Steven Gilbert, 44, for two assault convictions and imposed a term of reporting probation on him.

Gilbert committed the first assault in Mount Uniacke May 5 and the second June 6. He pleaded guilty to the charges Oct. 20, when sentencing was scheduled pending a pre-sentence report.



Assault nets probation

Falmouth resident Mark Leslie Brooks, 36, pleaded guilty Tuesday, Dec. 2 to committing an assault.

Judge MacDonald suspended sentencing on Brooks for the conviction and imposed a term of one-year probation on him.

Probationary conditions include that Brooks take any recommended assessment, counselling or treatment; refrain from possessing or consuming alcoholic beverages or non-medically prescribed drugs; initiate no contact with the victim; and stay away from the victim’s residence.

As well, the judge imposed a two-year firearms possession ban on the accused.

Brooks committed the assault in Falmouth Oct. 3.



Fined for breach

Summerville resident Francis Gordon Wheadon, 66, pleaded guilty Dec. 9 to failing to comply with a court undertaking condition that he not possess or consume alcoholic beverages.

Judge Tufts fined Wheadon $50 plus a $7.50 victim surcharge. Wheadon committed the breach in Summerville May 6.



Possessed marijuana

Belliveau Cove, Digby County resident Mark Phillip Robichaud, 46, pleaded guilty Dec. 2 to possession of cannabis marijuana, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA).

Judge MacDonald fined Robichaud $300 plus a $45 victim surcharge, or five days in custody on willful default.

Robichaud committed the offense on Highway 101 in Windsor Oct. 29.



Short sentence

Kentville resident John Leander Hank Gibson, 47, pleaded guilty Dec. 5 to failing to comply with a probation order.

Judge MacDonald sentenced Gibson to one day in custody deemed served by his court appearance.

Gibson committed the breach in Kentville Dec. 4.



Sped

Kentville resident Charles Lenn Herritt, 40, pleaded guilty Dec. 5 to driving between one and 15 kilometres in excess to the posted speed limit, contrary to the Nova Scotia Motor Vehicles Act (MVA).

Judge MacDonald fined Herritt $100 plus a $15 victim surcharge and $107 in costs.

Herritt committed the offense on Highway 101 in St. Croix Sept. 18.



Convicted automatically

Judge Tufts convicted automatically Lower Vaughan resident Norman Harris Boutilier, 19, Dec. 9 of driving while his privilege of obtaining a license was revoked, contrary to the MVA, and fined him $1,000 plus a $107 victim surcharge.

Police laid the charge on Highway 14, Lower Vaughan Oct. 8. Boutilier did not appear in court as scheduled.



Granted conditional discharge

Judge Tufts granted a conditional discharge Dec. 9 to Windsor resident Aaron Timothy Macumber, 18, on charges of possession of property valued at less than $5,000 known to have been obtained unlawfully, and two counts of theft of property valued at less than $5,000.

The discharge is pending 12 months’ reporting probation and a $500 charitable donation to the Hants West Minor Hockey Association.

Probationary conditions include Macumber taking any recommended assessment, counselling or treatment; making the donation; having no communication with a specific person; and having no association with anyone with a criminal, drug or youth record.

The charges stemmed from incidents in Falmouth June 4 when a bike and a camera were stolen, and materials recovered.

Macumber pleaded guilty to the charges Dec. 9.
