Refused to provide breath sample

Stanley resident Raymond Edward Lowe, 66, pleaded guilty in Windsor provincial court Tuesday, Nov. 25 to refusing to provide a breath sample for blood-alcohol analysis.

Judge Alan Tufts fined Lowe $1,100 plus a $165 victim surcharge, or 19 days in custody on willful default, and prohibited him from driving in Canada for a year.

The Nova Scotia Registry of Motor Vehicles will ban Lowe from driving in the province for at least a year.

Lowe committed the refusal in Windsor, Sept. 22.

Drove with illegal blood-alcohol readings

Windsor resident Kevin David Way Turner, 54, pleaded guilty Nov. 25 to driving while his blood-alcohol readings exceeded the legal limit.

Judge Tufts find Turner $1,000 plus a $150 victim surcharge, or 17 days in custody on willful default.

The judge also prohibited Turner from driving in Canada for a year, a ban the provincial Registry of Motor Vehicles will at least match.

Turner committed the offense in Windsor Oct. 10 when police found he had blood-alcohol readings of 120 and 110 milligrams or alcohol per 100 millilitres of blood.

The legal limit is 80 mg/100 ml.

Three-month interlock clause

Bedford, Halifax County resident Sherri Monique Grant, 42, pleaded guilty Nov. 25 to refusing to provide a breath sample for blood-alcohol analysis.

Judge Tufts fined Grant $600 plus a $90 victim surcharge, or 10 days in custody on willful default.

The judge also prohibited Grant from driving in Canada for a year, a ban the Registry of Motor Vehicles will at least match. However, he provided for Grant the opportunity to apply for an interlock device for her vehicle after three months.

Grant committed the refusal in Hants Border, June 14.

Possessed unstamped smokes

Upper Falmouth resident Everett Nelson Patterson, 73, pleaded guilty Nov. 25 to possession of cigarettes that were not stamped, contrary to the Excise Act.

Judge Tufts fined Patterson $500 and forfeited materials involved in the crime, though he may apply for their return.

Patterson committed the offense in Upper Falmouth Sept. 27.

Convicted automatically

Judge Tufts convicted automatically New Glasgow, Pictou County resident Kevin Frederick Smith, 22, Nov. 25 of disturbing the occupants of a premises by disorderly behaviour, contrary to the Protection of Property Act.

The judge fined Smith $100 plus a $15 victim surcharge and $107 in costs.

Police laid the charge in Windsor Aug. 31. Smith didn’t show for his scheduled Nov. 25 court hearing.

Judge Tufts convicted automatically Monastery, Antigonish County resident Paul Noble Taylor, 52, Nov. 25, of illegal possession of liquor, contrary to the Nova Scotia Liquor Control Act (LCA), and fined him $300 plus a $45 victim surcharge and $107 in costs.

Police laid the charge in Windsor Nov. 5. Taylor failed to attend the court hearing on the matter Nov. 25.
