Probation, fines for various offenses

A Three Mile Plains man has received a probationary term for a recognizance breach, and fines for other offenses.

William Jade Hennigar, 34, pleaded guilty in Windsor provincial court Monday, Sept. 22 to failing to comply with a recognizance breach; having care and control of a motor vehicle while his blood-alcohol readings exceeded the legal limit; possession of unstamped tobacco products, cigarettes, contrary to the Excise Act; and possession of cannabis resin, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA).

Judge Claudine MacDonald suspended sentencing on Hennigar for the recognizance breach and imposed a term of one-year reporting probation on him. Probationary terms include Hennigar taking any recommended assessment, counselling or treatment; not initiating contact with a specific person; and to refrain from possessing or consuming alcoholic beverages or non-medically prescribed drugs.

Hennigar committed the breach in Newport Station Sept. 27, 2007 when he had contact with a person he was prohibited from doing so.

For the breathalyzer offense, the judge fined Hennigar $850 plus a $127.50 victim surcharge, or 15 days in custody on willful default.

She also prohibited Hennigar from driving in Canada for a year, a ban the Nova Scotia Registry of Motor Vehicles will at least match.

Hennigar committed the breathalyzer offense in Windsor May 10, 2008 when police found he had blood-alcohol readings of 170 and 160 milligrams of alcohol per 100 millilitres of blood. The legal limit is 80 mg/100 ml.

For the Excise Act offense, Judge MacDonald fined Hennigar $500 plus a $75 victim surcharge. Hennigar committed the offense in Windsor May 10.

For the CDSA offense, the judge fined Hennigar $150 plus a $22.50 victim surcharge, or two days in custody on willful default.

Hennigar committed the possession in Windsor Feb. 17.

Probation for breach

Greenhill resident Troy Edward Rafuse, 30, pleaded guilty Tuesday, Sept. 23 to failing to comply with a probation order to keep the peace and be of good behaviour.

Judge MacDonald suspended sentencing on Rafuse for the breach and imposed a term of eight months’ probation on him.

Probationary conditions include Rafuse taking any recommended assessment, counselling or treatment and refraining from possessing or consuming alcoholic beverages or non-medically prescribed drugs.

Rafuse committed the breach in Greenhill March 10.

Fines for possession, MVA offenses

New Minas resident George Loran Lewis, 37, pleaded guilty Sept. 23 to possession of property valued at less than $5,000 and known to have been obtained unlawfully, and two counts of driving while his privilege of obtaining a driver’s license was revoked, contrary to the MVA.

Judge MacDonald fined Lewis $100 plus a $15 victim surcharge, or two days in custody on willful default, for the stolen property possession, and $500 plus a $75 victim surcharge each for the MVA offenses.

Lewis committed the possession in Windsor March 25, the first MVA offense in Falmouth the same date, and the second MVA offense in Greenwich, Kings County, May 29.

Convicted automatically

Judge MacDonald convicted automatically Indian Brook resident Leo Peter Paul, 34, Sept. 23 of driving while his privilege of obtaining a driver’s license was revoked, contrary to the MVA, and fined him $500 plus a $75 victim surcharge.

Police laid the charge in Brooklyn Dec. 29, 2007.
