Assaults, threats net probation

The court has imposed a term of probation on a Windsor Forks man for assaults and threats.

In Windsor provincial court Monday, Sept 15, Judge Alan Tufts suspended sentencing on Willis Arnold Kitchin, 55, and imposed a term of 18 month probation for two counts of assault against two people and one count of uttering threats to do the assault victims bodily harm.

Probation conditions include Kitchin taking any recommended assessment, counselling or treatment; refraining from possessing or consuming alcoholic beverages or non-medically prescribed drugs; not contacting or communicating with the victims, or going to their home.

The judge also ordered Kitchin to provide a DNA sample to be kept on file.

Kitchin committed the assaults and threats during an incident in Windsor June 22. He pleaded guilty to the charge July 12.

Had care and control



Halifax resident Kyle John Pepper, 20, pleaded guilty Tuesday, Sept. 16, to having care and control of a motor vehicle while his blood-alcohol readings exceeded the legal limit.

Judge Alan Tufts fined Pepper $1,200 plus a $180 victim surcharge, or 21 days in custody on willful default.

The judge also prohibited Pepper from driving in Canada for a year, but included a clause to allow for an interlock device after three months.

The Nova Scotia Registry of Motor Vehicles will at least match the national driving ban on Pepper.

Pepper committed the offense in Newport Station July 22, when police found that he had blood-alcohol readings of 150 and 150 milligrams of alcohol per 100 millilitres of blood. The legal limit is 80 mg/100 ml.

Fined for theft

Judge Tufts fined Lawrencetown, Annapolis County, resident Donna Balcom, 45, $300 plus a $45 victim surcharge, or five days in custody on willful default, for theft of a vehicle valued at more than $5,000.

Balcom committed the theft in Falmouth Oct. 10, 2007, and pleaded guilty to the charge June 10.

Attempted to defraud pharmacy

Windsor resident Michael Atkinson, 32, pleaded guilty Sept. 15 to attempting to defraud a pharmacy of a prescription.

Judge Tufts fined Atkinson $50 plus a $7.50 victim surcharge.

Atkinson committed the fraud in Windsor Oct. 16, 2007.

Failed to drive prudently, carefully

Falmouth resident Aaron Charles Lunn, 35, pleaded guilty Sept. 16 to failing to drive in a careful and prudent manner, contrary to the Nova Scotia Motor Vehicles Act (MVA).

Judge Tufts fined Lunn $150 plus a $22.50 victim surcharge and $107 costs.

Lunn committed the offense in Falmouth March 15.
