Breathalyzer offence results in fine

A Three Mile Plains man has received a fine for a breathalyzer offense.

The court fined Richard Wade Davis, 32, for operating a motor vehicle having consumed alcohol in such a quantity that the concentration thereof in his blood exceeded the legal limit.

Davis entered a guilty plea to the charge in Windsor provincial court Tuesday, Sept. 2. The court fined him a total of $1,265 and has been given until Nov. 25, 2008, to pay or spend 19 days in custody on willful default. The court has also imposed a one-year, Canada-wide driving prohibition against Davis, a ban the Nova Scotia Registry of Motor Vehicles will at least match.

Davis committed the offence in Windsor July 11, 2008, when he operated a motor vehicle having consumed alcohol in such a quantity that the concentration thereof in his blood exceeded 80 milligrams of alcohol in 100 millilitres of blood, the legal limit. Davis gave breathalyzer readings of 120 and 120 mg of alcohol per 100 ml of blood.



In other court matters

The court has fined Terry James Decker, 32, Mount Uniacke, for driving a motor vehicle while his drivers’ license or privilege of obtaining a drivers’ license was suspended, contrary to the Nova Scotia Motor Vehicles Act (MVA).

Decker entered a guilty plea to the charge on Sept. 2. He was fined a total of $500 and has been given until Jan. 27, 2009, to pay with no default.

Decker committed the offence on Etter Road, Mount Uniacke, May 8, 2008.

The court has fined Melanie Skye MacLeod, 21, Dartmouth, for driving at a speed exceeding the posted limit, contrary to the MVA.

MacLeod entered a not guilty plea to the charge June 24, 2008, and the matter was adjourned to Sept. 2 for trial. Evidence was heard at the Sept. 2 trial, resulting in MacLeod being found guilty of the offence.

MacLeod was fined a total of $172.50 and was given until Jan. 27, 2009, to pay with no default.

MacLeod committed the offence in Mount Uniacke May 8, 2008.

The court has fined Derrick Wade Maxwell, 40, Mount Uniacke, for driving a motor vehicle while his drivers’ license or privilege of obtaining a drivers’ license was suspended, contrary to the MVA.

Maxwell entered a guilty plea to the charge Sept. 2. He was fined a total of $500 and was given until Jan. 27, 2009, to pay with no default.

Maxwell committed the offence at Highway 1 and Etter Road, Mount Uniacke, April 30, 2008.

The court has fined Robert John Walsh, 53, Mount Uniacke, for driving a motor vehicle while his drivers’ license or privilege of obtaining a drivers’ license was revoked, contrary to the MVA.

Walsh’s wife entered a guilty plea to the charge on his behalf Sept. 2. Walsh was fined a total of $500 and has been given until Jan. 27, 2009, to pay with no default.

Walsh committed the offence at Highway 1 and Etter Road, Mount Uniacke, April 30, 2008.

Convicted automatically

Owen Robert Taggart, 20, Mount Uniacke, has been automatically convicted and fined for displaying number plates issued for another vehicle, contrary to the MVA.

The accused was not present in court Sept. 2, 2008, and a Crown motion for an automatic conviction was entered and granted. Taggart was fined a total of $164.50 and was given until Oct. 28, 2008, to pay with no default.

Police laid the charge on Highway 14 in Upper Vaughan July 8, 2008.
