House arrest for trafficking

The court has sentenced a Kentville man to house arrest for trafficking in a Schedule I drug under the Controlled Substances Act (CDSA).

Wade Nelson Coleman, 70, pleaded guilty in Kentville provincial court Tuesday, Aug. 5 to trafficking in dilaudid, a Schedule I drug under the Act.

Judge Claudine MacDonald imposed a conditional sentence order (CSO) of two years less a day on Coleman. The first 14 months of the CSO are to be served under house arrest, with eth usual exceptions. The remainder will be in the form of a curfew.

Judge MacDonald also imposed a 12-year firearms prohibition on Coleman, ordered him to provide a DNA sample to Corrections officials, and forfeited the materials involved in the crime.

Coleman committed the offense in Kentville April 8.

Jailed for breaches, theft

Kristin Maria Rau, 23, of no fixed address, pleaded guilty to two counts of failing to comply with probation orders, failing to comply with an undertaking and theft of property valued at less than $5,000.

Judge MacDonald sentenced Rau to 15 days in custody for each of the offenses, to be served consecutive to each other, for a total of 60 days.

Rau must also pay $460 in restitution for the theft.

Rau committed the first probation breach in Kentville July 31; the theft and second probation breach between Aug. 1 and 3; and the undertaking breach, Aug. 4.

Probation for assault, threat

Kentville resident Douglas Robert Moore, 58, pleaded guilty Aug. 5 to threatening to cause death or bodily harm to a person. He had also pleaded guilty May 26 to assault.

Judge MacDonald suspended sentencing on Moore for the convictions and imposed a term of two years probation, conditions of which include his taking any recommended assessment, counselling or treatment; refraining from possessing or consuming alcoholic beverages or non-medically prescribed drugs; and not initiating contact with the victim.

The judge also prohibited Moore from possessing firearms for five years.

Moore committed the assault and threat in Kentville may 4.

Fined for breathalyzer readings

New Minas resident Stephanie Amelia Oikle, 21, pleaded guilty Aug. 5 to driving while her blood-alcohol readings exceeded the legal limit.

Judge MacDonald fined Oikle $850 plus a $127.50 victim surcharge, or 15 days in custody on willful default.

She also prohibited Oikle from driving in Canada for a year, a ban the Nova Scotia Registry of Motor Vehicles will at least match.

Oikle committed the offense in Kentville May 24, when police found she had blood-alcohol readings of 110 and 100 milligrams of alcohol per 100 millilitres of blood. The legal limit is 80 mg/100 ml.

Fines, probation for drug possession

Waterville resident Randolph Scott Reynolds, 36, pleaded guilty Aug. 5 to possession of more than 30 grams of cannabis marijuana, and to possession of less than 30 grams of marijuana, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA).

Judge MacDonald fined Reynolds $150 plus a $22.50 victim surcharge, or two days in custody on willful default, for the possession over 30 grams, and $200 plus a $30 victim surcharge for the possession less than 30 grams. She also imposed a term of six months probation on Reynolds for the offenses.

Reynolds committed the possession over in New Minas April 11, and the possession under, in Kentville, May 16.



Possessed drugs for purpose

Berwick resident Michael Stephen Cochrane, 58, pleaded guilty Wednesday, Aug. 6, to possession of dilaudid, a Schedule I drug under the CDSA, for the purpose of trafficking; possession of marijuana for the purpose of trafficking; and possession of more than a gram of cannabis resin, a Schedule II drug under the Act.

Judge MacDonald fined Cochrane $800 plus a $120 victim surcharge, or 14 days in custody on willful default for the dilaudid possession; $200 plus a $30 victim surcharge, or three days, for the marijuana possession; and $300 plus $45, or five days for the resin possession.

Cochrane committed the offenses in Berwick Sept. 21, 2007.



Granted conditional discharge

Judge MacDonald granted a conditional discharge Aug. 6 to canning resident Lisa Eileen Ellis, 39, on charges of assault and failing to comply with an undertaking. The discharge is pending six months reporting probation, of which conditions include Ellis having no contact with a specific person, and taking any recommended assessment, counselling or treatment.

The assault charge stemmed from an incident in canning April 30, while the breach resulted form an incident in canning June 16.

Ellis pleaded guilty to the charges Aug. 6.
