Breached probation

Canning resident Ricky Allan Carter, 25, pleaded guilty May 26 to failing to comply with a probation order.

Judge MacDonald fined Carter $100 plus a $15 victim surcharge, or one day in custody on willful default.

Carter committed the breach between Jan. 27 and March 4 when he failed to report to and be under the supervision of Corrections officials.

Possessed marijuana

Berwick resident Grace Marie Parker, 36, pleaded guilty May 26 to possession of cannabis marijuana, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA).

Judge MacDonald fined Parker $100 plus a $15 victim surcharge, or one day in custody on willful default. Parker committed the possession in Berwick April 14.

Had trace of alcohol

North Alton resident Trevor James Jones, 19, pleaded guilty May 26 to having a trace of blood/alcohol in his blood while a new driver, contrary to the Nova Scotia Motor Vehicles Act (MVA). He also requested a remission of penalty.

Denying the remission, Judge MacDonald fined Jones $250 plus a $37.50 victim surcharge and $107 in costs. Jones committed the offense in Kentville March 21.

Jailed for harassment, breaches

A Grafton man is off to jail for harassment and breaches.

In Kentville provincial court May 29, Judge Claudine MacDonald found Randy Dale McMullin, 54, guilty of harassment by means of repeated telephone calls, failing to comply with probation conditions and failing to comply with recognizance conditions.

MacDonald sentenced McMullin to three months in custody for the harassment conviction, 15 days consecutive for the probation breach and 15 days concurrent for the recognizance breach.

McMullin committed the harassment and breaches in Kings County between Oct. 12 and Dec. 11, 2007.

Probation for assault, mischief

Judge MacDonald suspended sentencing on Wolfville resident Frank Graham Fisher, 31, May 29 on convictions of assault and mischief and imposed a term of six months’ reporting probation. Probation conditions also include Fisher paying $100 in restitution for the mischief, which involved property damage less than $5,000, and his having no contact with a specific person without permission.

Fisher committed the assault and mischief in Kentville March 5. He pleaded guilty to the mischief charge April 14 and to the assault May 24.

Dangerous driving, resisting, breaches

The court has sent a Baxter’s Harbour resident to jail for a series of offenses including dangerous driving, evading police, resisting arrest and breaches.

Judge Claudine MacDonald sentenced Mark David Houghton, 33, in Kentville provincial court May 27 to five months’ custody each for driving in a manner dangerous to the public and failing to stop as soon as possible while pursued by police. She also sentenced him to 60 days in custody each for resisting a police officer in the execution of duties, two counts of failing to comply with probation orders and two counts of failing to comply with recognizance orders. The sentences are to be served concurrently. For the dangerous driving conviction, Judge MacDonald also prohibited Houghton from driving in Canada for two years and five months.

Houghton committed the dangerous driving, failure to stop and first probation breach in Kentville March 23. He pleaded guilty to those charges April 4.

The accused committed the first recognizance breach in Wallbrook April 3, the resisting police, the second recognizance breach and second probation breach in Kentville April 9. He pleaded guilty to those charges May 15.

High blood/ alcohol readings

The court imposed a fine on a Kingston woman for driving with blood/alcohol readings well over twice the legal limit.

Amy Jean Chipman, 27, pleaded guilty to the charge in Kentville provincial court Monday, May 26.

Judge Claudine MacDonald fined Chipman $1,000 plus a $150 victim surcharge, or 17 days’ custody on willful default.

The judge also imposed a one-year, Canada-wide driving prohibition on Chipman. The Nova Scotia Registry of Motor Vehicles will ban Chipman from driving in the province for at least a year.

Chipman committed the offense in Greenwood March 22 when police found she had blood/alcohol readings of 230 and 220 milligrams of alcohol per 100 millilitres of blood. The legal limit is 80 mg/ 100 ml.

The Criminal Code of Canada allows for heavier penalties in those breathalyzer cases in which readings exceed 160 mg/ 100 ml, and for other aggravating factors.

Drove while level over the limit

Kentville resident Christopher Anderson Herman, 37, pleaded guilty May 26 to driving while his blood/alcohol level exceeded the 80-mg limit.

Judge MacDonald fined Herman $850 plus a $125.50 victim surcharge, or 15 days’ custody on willful default, and prohibited him from driving in Canada for a year. The Registry of Motor Vehicles will impose a ban for at least as long.

Herman committed the offense in Kentville April 8, when police found he had blood/alcohol readings of 140 and 130 mg/ 100 ml.

Had care and control

Pereau resident Elizabeth Rachel Sheffield, 49, pleaded guilty May 26 to having care and control of a vehicle while her blood/alcohol readings exceeded the 80-mg limit.

Judge MacDonald fined Sheffield $900 plus a $135 victim surcharge, or 15 days’ custody on willful default. MacDonald also imposed on Sheffield a Canada-wide, one-year driving ban, which the Registry of Motor Vehicles will at least match.

Sheffield committed the offense in North Kentville April 12, when police found she had blood/ alcohol readings of 120 and 120 mg/ 100 ml.

Fined for breathalyzer

Wolfville resident Mohammed Abdullah Alhelal, 19, pleaded guilty May 26 to driving while his blood/ alcohol level exceeded the 80-mg limit.

Judge MacDonald fined Alhelal $800 plus a $120 victim surcharge, or 14 days’ custody on willful default. The judge also prohibited Alhelal from driving in Canada for a year, a ban the Motor Vehicles Registry will at least match.

Alhelal committed the offense in Wolfville April 5 when police found he had blood/ alcohol readings of 130 and 120 mg/ 100 ml.

Probation for assault

Judge MacDonald suspended sentencing on Antony Fernando Moore, 33, on a conviction of assault, and imposed a term of eight months’ reporting probation on him.

Conditions of the probation include Moore taking recommended assessment, counselling or treatment and having no communication with the victim.

Moore committed the assault in Kentville March 8 and pleaded guilty to the charge April 14.

Resisted police, caused disturbance

Canning resident Cory Martin Gould, 37, pleaded guilty May 26 to resisting a police officer in the execution of duties and to causing a disturbance in a public place by shouting and swearing.

Judge MacDonald fined Gould $500 plus a $75 victim surcharge, or eight days in custody on willful default for resisting police, and $50 plus a $7.50 victim surcharge for causing the disturbance.

Gould committed the offenses in Greenwood March 30.

Theft nets probation

Berwick resident Dale Steven MacTavish, 19, pleaded guilty to theft May 26.

Judge MacDonald suspended sentencing on MacTavish for the conviction and imposed a term of six months’ reporting probation. Probationary conditions include a curfew.

MacTavish committed the theft in Kentville March 31.

Fined for mischief

Kentville resident Nikolas Lawrence Wellwood, 21, pleaded guilty May 26 to committing mischief.

Judge MacDonald fined Wellwood $300 plus a $45 victim surcharge, or five days in custody on willful default.

Wellwood committed the mischief in Kentville April 8 when he caused damage costing less than $5,000 to a property.

Breached probation

Waterville resident Michael James Hiscoe, 45, pleaded guilty May 26 to driving without the required liability insurance, contrary to the MVA.

Judge MacDonald fined Hiscoe $1,000 plus a $150 victim surcharge. Hiscoe committed the offense in Waterville Oct. 8, 2007.

License was suspended

Kentville resident Cecil James Dominey, 25, pleaded guilty May 26 to driving while his license was suspended, contrary to the MVA. Judge MacDonald fined Dominey $500 plus a $75 victim surcharge.

Dominey committed the offense in Kentville April 27.

Convicted automatically

Judge MacDonald convicted automatically Berwick resident Michael Richard Roberts, 46, of driving an unregistered vehicle, contrary to the Government Property Traffic regulations (GPTR).

The judge fined Roberts $50 plus a $7.50 victim surcharge and $107 in costs.

Police laid the charge at 14 Wing Greenwood April 7.
