Jellohead’s repeated breaches of probation have earned him 45 days of jailtime at the correctional centre in Yarmouth.
Robert Chetwynd (38) is a Shelburne County man who made headlines in 2003 when he refused to stop riding his horse through a Tim Horton’s drive-thru.
On Nov. 9, 2006 Chetwynd was convicted on charges including a breach of probation, as well as counts under the animal cruelty prevention act, motor vehicle act and protection of property act.
He was placed on a probation order and sentenced to four months of custody although he was allowed to serve it on a conditional sentence order.
Crown Attorney Jim Fyfe says one of the conditions on that order was that Chetwynd not ride his horse on any public road or highway.
“He breached that condition on three occasions: May 20, 25 and July 19, 2007. On Jan. 24, 2008 he was found guilty of three breaches of probation with a sentencing on April 17 to 15 days in jail consecutively for each breach of probation (45 days total) and 12 months probation to follow,” said Fyfe.
The conditions of that probation include an order not to possess on any public highway, any animal capable of being driven by a human being.
“The judge wanted to be very specific,” said Fyfe.
Although Chetwynd is now serving time at the Yarmouth facility he will be back in court on May 1 to set a date for a trial on charges of uttering threats and three breaches of probation.
He also has eight other breaches of probation that are alleged against him, set for May 1 when he will be making a plea.
