Conditional sentence on multiple charges
The court has imposed a conditional sentence order on Matthew David Taillon, 21, address unknown, for committing break and enter and committing an indictable offence therein; committing break and enter with the intent of committing an indictable offence therein; two counts of failing to comply with conditions of a probation order by which he was bound; and for failing without lawful excuse to comply with a condition of a recognizance by which he was bound while being at large on the recognizance.
Taillon entered not guilty pleas Feb. 12, 2007 to the charges of break and enter and committing an indictable offence, break and enter with intent to commit an indictable offence, and one count of failing to comply with a condition of a probation order by which he was bound. Taillon changed his pleas to guilty on the charges March 6, 2008.
Taillon entered a guilty plea Jan. 10, 2008 to the charge of failing to comply with a condition of a recognizance. He entered a not guilty plea Jan. 10 to the other charge of failing to comply with a condition of a probation order by which he was bound. He changed his plea to guilty March 6, 2008.
The matters were adjourned to April 1, 2008 to allow time for a pre-sentence report to be prepared and for sentencing.
The court handed Taillon a one-year conditional sentence order April 1, 2008 to be followed by one-year of probation on the five charges. A curfew has been imposed on Taillon as part of the conditional sentence. He must remain in his home between midnight and 6 a.m.
Taillon committed the offences in Kentville between Feb. 1 and June 11, 2007 and between March 3 and Dec. 28, 2007 and in New Minas Feb. 2, 2007.
Willfully damaged property
The court has handed Thomas Charles Turner, 39, Rockland, a conditional discharge with probation for willfully damaging the property of an individual of a value not exceeding $5,000.
Turner entered a not guilty plea to the charge Oct. 29, 2007. The matter was adjourned to Feb. 21, 2008 for trial. Turner was found guilty of the offence at trial. The matter was adjourned to March 31, 2008 to allow time for a pre-sentence report to be prepared and for sentencing.
The court handed Turner a conditional discharge with 12 months’ probation March 31, 2008. The court has ordered Turner to pay $601.73 in restitution to the victim through the court within the term of the probation order.
Turner committed the offence in Coldbrook July 3, 2007.
Impaired driving
The court has fined Jacqueline Violet Raczkevi, 36, New Minas, for operating a motor vehicle having consumed alcohol in such a quantity that the concentration in her blood exceeded the legal limit.
Raczkevi entered a guilty plea to the charge March 31, 2008. She was fined a total of $1,035 and has been given until Oct. 27, 2008 to pay or spend 17 days in custody on willful default. The court imposed a one-year, Canada-wide driving prohibition order against Raczkevi.
Raczkevi committed the offence in Kentville Jan. 25, 2008 when she operated a motor vehicle having consumed alcohol in such a quantity that the concentration in her blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Raczkevi gave breathalyzer readings of 170 and 160.
Breathalyzer offence
The court has fined David Gauthier, 26, Greenwood, for operating a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded the legal limit.
Gauthier entered a guilty plea to the charge March 31, 2008. He was fined a total of $977.50 and has been given until July 28, 2008 to pay or spend 16 days in custody on willful default. The court imposed a one-year, Canada-wide driving prohibition against Gauthier.
Gauthier committed the offence in Greenwood Jan. 26, 2008 when he operated a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Gauthier gave breathalyzer readings of 150 and 140.
Drove while license suspended
The court has fined David Todd McLellan, 32, Bishopville, for unlawfully driving a motor vehicle while his driver’s license was suspended.
McLellan entered a guilty plea to the charge March 31, 2008. He was fined a total of $575 and has been given until July 28, 2008 to pay with no default.
McLellan committed the offence in Kentville Jan. 29, 2008.
Failed to comply
The court has fined Luke Shane Taylor, 19, Hall’s Harbour, for failing without lawful excuse to comply with a condition of a recognizance by which he was bound while he was at large on the recognizance.
Taylor entered a guilty plea to the charge March 28, 2008. He was fined a total of $230 and has been given until April 29, 2008 to pay or spend three days in custody on willful default.
Taylor committed the offence in Kentville March 27, 2008.
Failed to comply with probation
The court has fined Timothy James Lutz, 38, no fixed address, for failing to comply with a condition of a probation order by which he was bound.
Lutz entered a guilty plea to the charge March 31, 2008. He was fined a total of $172.50 and has been given until Oct. 27, 2008 to pay or spend two days in custody on willful default.
Lutz committed the offence in Berwick Oct. 11, 2007 when, without reasonable excuse, he failed to comply with a condition of a probation order by which he was bound, not to possess alcohol.
Stole property
The court has fined Sandra Lee Schofield, 58, Sunken Lake, for stealing the property of an individual of a value not exceeding $5,000.
Schofield entered a guilty plea to the charge March 31, 2008. She was fined $57.50 and ordered to pay the fine immediately, by March 31, with no default.
Schofield committed the offence in New Minas Feb. 13, 2008.
