Custody for offenses

The court has sent a Kentville man to jail for seven offenses, including breaches, mischief, drug possession and threatening and assaulting police.

Judge Claudine MacDonald found Dean Patrick Gibson, 38, guilty in Kentville provincial court Tuesday, Feb. 19 of assaulting a police officer executing his duties and of failing to comply with a recognizance order.

Gibson pleaded guilty to threatening to cause death or bodily harm to another police officer and to two counts each of mischief and another recognizance breach, and to possession of cannabis marijuana, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA).

Judge MacDonald sentenced Gibson to three months each for the assault, threat and first mischief convictions; four months each for the two recognizance breaches and the second mischief; and seven days for the CDSA conviction.

The four-month and seven-day sentences will be served concurrently with each other, as will the three-month terms, but the two groups of sentences will be served consecutively with each other for a total of seven months in custody.

Gibson committed the assault, threat and first mischief in Kentville June 25. The mischief involved damaging municipal property.

He committed the breaches, second mischief and possession in Kentville Dec. 27. Again the mischief involved damage to municipal property.

Gibson has been on remand since his arrest in late December.

CSO for thefts, possession, failure to attend

New Minas resident Tina Marie Davidson, 37, pleaded guilty Wednesday, Feb. 20 to possession of oxycodone, a Schedule I drug under the Controlled Drugs and Substances Act (CDSA), and to failing to attend court as ordered. She had previously pleaded guilty June 20, 2007 to four thefts from businesses in Wolfville and New Minas.

Judge MacDonald imposed a 30-day conditional sentence order (CSO) followed by one-year probation on Davidson for each offense, to be served concurrently. The CSO involves curfew.

Probationary conditions include Davidson taking any recommended assessment, counselling or treatment.

Davidson committed the first theft in Wolfville Dec. 1, 2006; the second in New Minas Jan. 29, 2007; the third theft, March 15; and the fourth May 24. She failed to attend court Sept. 12, 2007 and committed the drug possession Sept. 12.

Theft and dangerous driving net probation

Judge MacDonald imposed 15 months of probation on Maplewood resident Kyle Nathaniel Aulenback, 18, for both theft of property valued at less than $5,000 and for driving in a manner dangerous to the public. She also ordered Aulenback to perform 50 hours of community service work.

Aulenback committed the theft and dangerous driving in Kentville Oct. 14 and pleaded guilty to the first charge Jan. 7 and the second Jan. 21.

Probation for breach and threat

Kentville resident Allen Victor Burton, 53, pleaded guilty Feb. 19 to threatening to cause death or bodily harm to a person and to failing to comply with an undertaking.

Judge MacDonald suspended sentencing on Burton for the convictions and imposed a term of nine months’ non-reporting probation on him. She also imposed a five-year firearms ban on the accused.

Probationary conditions include that Burton have no contact with the victim and to stay away from that person’s home.

Burton committed the threat and breach in Kentville Nov. 11.

Theft, breach result in probation

Kentville resident Michael Roy Atkinson, 31, pleaded guilty Feb. 19 to failing to comply with an undertaking. He had pleaded guilty Jan. 22 to theft of property valued at less than $5,000.

Judge MacDonald suspended sentencing on Atkinson for the convictions and imposed a term of nine months’ non-reporting probation.

Atkinson committed the theft and breach in Woodville May 25.

Old offenses result in fines

Judge Alan Tufts fined north Kentville resident Stephen Carman Agius, 26, $100 plus a $15 victim surcharge, or one day in custody on willful default, for assault, three thefts from businesses, and failing to attend court.

Agius committed the first theft at a Kentville business Nov. 8, 2000; the assault and two thefts from New Minas businesses Nov. 23, 2000; and failed to attend court in Kentville Dec. 19, 2001.

Agius had pleaded guilty to the Nov. 23, 2000 offenses Dec. 5, 2001, and the other two Dec. 31, 2007.

Fined for theft

North Kentville resident Dana James Woolaver, 34, pleaded guilty Feb. 19 to theft of property valued at less than $5,000.

Judge MacDonald fined him $300 plus a $45 victim surcharge, or five days in custody on willful default.

Woolaver committed the theft at Dempsey’s Corner April 12.

Failed to get supervised

Kings County resident Robert Michael Cory Wier, 25, pleaded guilty Feb. 20 to failing to comply with a probation order.

Judge MacDonald fined Weir $300 plus a $45 victim surcharge, or five days in custody on willful default.

Weir committed the breach in Kentville between April 12 and June 23, 2006 when he failed to be supervised by a probation officer.

Failed to report

Aylesford resident Barry Kimberley Rawding, 31, pleaded guilty Feb. 19 to failing to comply with a probation order to report to probation officials.

Judge MacDonald fined Rawding $300 plus a $45, or five days in custody on willful default.

Rawding committed the breach in Kentville between Aug. 9 to Sept. 28, 2007.

MVA offenses cost thousands

Eight Nova Scotia Motor Vehicles Act (MVA) convictions have cost Greenwood resident Douglas John Oliver, 48, a total of $5,175.

Oliver pleaded guilty Feb. 19 to two counts of driving without the required liability insurance; three counts of driving while his privilege of obtaining a license was revoked; driving an unregistered vehicle; driving a vehicle that had no valid inspection sticker; and having no permit for a vehicle.

Judge MacDonald fined Oliver $1,000 each for the insurance and license offenses; $100 for the unregistered vehicle; $50 for lacking the inspection sticker; $25 for having no permit.

Oliver committed one license offense in Kingston March 14; the first insurance and the second license and the permit offenses in Kingston March 29; and the other offenses in Berwick Jan. 5, 2008.
