Jailed for assault, thefts, breaches

The court has jailed a Kentville woman for a series of offenses she committed earlier this year.

Kristen Maria Rau, 22, pleaded guilty in Kentville provincial court Wednesday, Feb. 13 to assault with a weapon, two counts of theft and four counts of failing to comply with probation orders.

Judge Alan Tufts sentenced Rau to a total of four months for the offenses: two months for one theft and breach; one month for the assault and breach; and one month for a theft and breach and one month for a breach, all to be followed by 12 months of reporting probation. Some of the sentences are concurrent with some and consecutive with others for the total of four months.

Probationary conditions include Rau taking recommended assessment, counselling or treatment.

Rau committed a theft and breach in Kentville Jan. 1; another theft and breach between Jan. 18 and 31; a probation breach Feb. 6; and the assault and breach Feb. 10.

CSO for not stopping, breach

A New Minas man has received conditional sentence orders (CSOs) for failing to stop for police, and a probation breach.

Jason Owen Strong, 25, pleaded guilty Monday, Feb. 11 to, in an effort to evade, failing to stop while pursued by police, and to failing to comply with a probation order.

Judge Alan Tufts imposed a six-month CSO, followed by 12 months of probation, on Strong for each of the convictions. The terms will be served consecutively.

The CSO and probationary conditions, among others, include Strong taking recommended assessment, counselling or treatment, and refraining from consuming or possessing alcoholic beverages.

Strong committed the evasion attempt and breach during an incident in Kentville Oct. 12.

Custody for theft, breaches

Kentville resident Darcy Raymond Caldwell, 19, pleaded guilty Feb. 13 to theft, two counts of failing to comply with recognizance orders and failing to comply with a probation order.

Judge Tufts sentenced Caldwell to 30 day in custody for each of the convictions, to be served concurrently.

Caldwell committed the probation breach in Kentville Dec. 23; the theft and first recognizance breach at the Kentville Liquor Commission; and the second recognizance breach Feb. 11.

Failed undertaking

Greenwood resident Steven George Ramsay, 32, pleaded guilty Feb. 13 to failing to comply with an undertaking.

Judge Claudine MacDonald sentenced Ramsay to one day in custody, deemed served by his court appearance.

Ramsay committed the breach in Kentville Nov. 1 and had been in remand by consent since Nov. 26.

Fined for breathalyzer

Lakeville resident Derrin Edward Millner, 30, pleaded guilty Feb. 12 to having care and control of a motor vehicle while his blood-alcohol level exceeded the legal limit.

Judge Tufts fined Millner $750 plus a $112.50 victim surcharge, or 14 days in custody on willful default.

He also prohibited Millner from driving in Canada for one year. The Nova Scotia Registry of Motor Vehicles will ban the accused from driving in Nova Scotia for at least a year.

Millner committed the offense in Coldbrook Jan. 1 when police found he had blood-alcohol readings of 150 and 150 milligrams of alcohol per 100 millilitres of blood.

The legal limit is 80 mg/100 ml.

Breached probation twice

Judge Tufts fined Wolfville resident Daniel John Connors, 24, $150 plus a $22.50 victim surcharge, or two days in custody on willful default, for failing to comply with a probation order, and a further $250 plus a $37.50 victim surcharge, or four days, for a second probation breach.

Connors committed the breaches in Wolfville June 8 and June 14, 2007 respectively. He pleaded guilty to the charges Dec. 18.

Probation, fine for damage

Kentville resident Paul Andrew Zinck, 40, pleaded guilty Feb. 11 to willfully damaging property, a windshield, costing less than $5,000.

Judge Tufts suspended sentencing on Zinck for the offense and imposed a term of nine months’ reporting probation and an order to pay $240 in restitution.

Probationary conditions include Zinck taking any recommended assessment, counselling or treatment and refraining from possessing or consuming alcoholic beverages or drugs.

Zinck committed the offense in Kentville Jan. 1.

Granted conditional discharge

Judge Tufts granted a conditional discharge Feb. 12 to Harbourville resident Scott Royce Kenneally, 21, on a charge of willfully causing damage costing less than $5,000 to property.

The discharge is pending four months of reporting probation and payment of $522.41 in restitution. Probationary conditions include the restitution and Kenneally refraining from possessing or consuming alcoholic beverages.

The charge resulted from a May 7, 2007 incident at a Harbourville business at which a window had been damaged.

In other court matters

Judge Tufts found Middle LaHave, Lunenburg County resident Jordan Byron Schofield, 20, guilty Feb. 12 of driving a vehicle without a valid inspection sticker, contrary to the Nova Scotia Motor Vehicles Act (MVA), and fined him $50 plus a $7.50 victim surcharge and $107 in costs.

Schofield committed the offense on Highway 12 in Kings County July 29.

Convicted automatically

Judge Tufts convicted automatically four motorists Feb. 11 for not wearing an available seatbelt, contrary to the MVA, and fined each of them $50 plus a $7.50 victim surcharge and $107 in costs. The convicted include Kingston resident William Doyle, 31; Aylesford resident Casandra Sue Oickle, 24; Kingston resident Garry Andrew Tooker, 42: and Middleton resident Carl Edwin Vroom, 45.

Police laid all charges in Kingston Dec. 10. The cases and incidents were not otherwise connected.
