Jailed for drugs, breach

A Kings County man is behind bars for two drug-related offenses and a recognizance breach he committed at Ellershouse last month.

Mark Walter Harris, 33, pleaded guilty in Windsor provincial court Friday, Sept. 28 to possession by indictment of methadone, a Schedule I drug under the Controlled Drugs and Substances Act (CDSA); possession of cannabis marijuana, a Schedule II drug under the Act; and failing to comply with a recognizance order to refrain from possession and/or consumption of non-medically prescribed drugs.

Judge Claudine MacDonald sentenced Harris to three months in custody for each of the offenses, to be served concurrently with each other.

Harris committed the offenses in Ellershouse Sept. 20.



Fine for contractor

A representative of Dartmouth-based Ocean Contractors Limited pleaded guilty Tuesday, Oct. 2 on the company’s behalf to failing to take every reasonable precaution in the circumstances to ensure the health and safety of personnel at or near a workplace, contrary to the Nova Scotia Occupational Health and Safety Act.

Judge Alan Tufts fined Ocean Contractors $17,500.

The company committed the offense on Highway 101 at Ellershouse June 18-22, 2006.

The Crown dropped three related charges against the company.



Expensive cigarettes

Windsor resident Allan Robert Hughes, 52, pleaded guilty Sept. 28 to possession of unstamped manufactured tobacco products, cigarettes, contrary to the Excise Act.

Judge MacDonald ordered Hughes to pay $2,000.24 in unpaid tax and fined him $500 plus a $75 victim surcharge. She also forfeited the cigarettes in question.

Hughes committed the offense in Windsor Aug. 4.



Thousands in MVA fines

Windsor resident Jason Richard Lantz, 27, pleaded guilty Oct. 2 to driving without the required liability insurance, two counts of driving while his privilege of obtaining a license was suspended, and driving in a manner causing unnecessary noise, squealing tires, all contrary to the Nova Scotia Motor Vehicles Act.

Judge Tufts fined Lantz $1,000 plus $100 in costs, or 30 days in custody on willful default, for the insurance offense; $500 plus $100 in costs, or 15 days, for each of the driving while suspended offenses; and $250 plus $10 in costs, or 10 days, for squealing his tires. The defaults would be served concurrently.

Lantz committed the insurance offense in Windsor July 23; the first suspended driving offense and the tire squealing in Garland’s Crossing Aug. 4; and the second license offense in Windsor, Aug. 17.



In other court matters

In court Sept. 28, Judge MacDonald fined Windsor resident Garnet D. Dykens, 32, $500 plus a $75 victim surcharge for failing to stop an off-highway vehicle as directed by a peace officer, and $250 for operating an off-highway vehicle on the shoulder of a highway, both contrary to the Nova Scotia Off-Highway Act.

Dykens committed the offenses on Walton Woods Road July 2 and pleaded guilty to the charges July 31.

Judge MacDonald fined Windsor resident Sarah Elizabeth Jackson, 18, $100 Sept. 28 for engaging in an activity prohibited by notice at a business, contrary to the Nova Scotia Protection of Property Act.

Jackson committed the infraction in Windsor Aug. 23 and pleaded guilty Sept. 25, when she asked for a remission of penalty.

The usual total penalty under the Act is approximately $222.
