Thefts, breach net house arrest

The court has imposed a term of house arrest and probation on a north Kentville man for thefts and a probation breach.

Lorne Harry McFee Allan, 20, pleaded guilty in Kentville provincial court Monday, July 30 to theft of property valued at less than $5,000 from an individual and to failing to comply with a probation order.

McFee had pleaded guilty May 28 to another theft from an individual, theft from a department store, and May 22 to theft from a convenience store.

Judge Alan Tufts imposed a four-month conditional sentence order (CSO), followed by eight months of reporting probation on Allan for the five convictions.

The first month of the CSO is in the form of house arrest with the usual exceptions for work, education, emergencies and appointments. The remainder is in the form of a curfew. The probationary conditions include McFee paying $500 in restitution to one of the individual victims.

MacFee committed the first theft against an individual and the probationary breach in Kentville between Nov. 10 and 15, 2006; the second theft against an individual, Kentville, Dec. 17; the theft from a Kentville convenience store Feb. 8, 2007; and the theft from a New Minas department store April 25.

CSO for theft

Judge Tufts imposed a six-month conditional sentence order on Kingston resident Brian James Keddy, 19, July 30 for theft of less than $5,000 from an individual.

The order includes three months’ curfew, with the latter three months involving a ban on Keddy leaving the province.

Keddy committed the theft in Greenwood July 15, 2006 and pleaded guilty to the charge June 5.

Fine, probation for readings

Greenwood resident Jonathan Paul Doyle, 26, pleaded guilty July 30 to driving while his blood-alcohol level exceeded the legal limit.

Judge Tufts fined Doyle $850 plus a $127.50 victim surcharge, or 16 days in custody on willful default, and imposed a term of eight months of reporting probation on him.

The probationary conditions include, among others, Doyle taking assessment, counseling or treatment recommended by Corrections officials, and a ban on possessing and/or consuming alcoholic beverages.

The judge also prohibited Doyle from driving in Canada for a year, a ban the Nova Scotia Registry of Motor Vehicles will at least match for the accused’s motoring within the province.

Doyle committed the offense at 14 Wing Greenwood June 16 when police found he had blood-alcohol readings of 200 and 210 milligrams of alcohol per 100 millilitres of blood.

The legal limit is 80 mg/100 ml under the Criminal Code, which provides for heavier penalties in those breathalyzer cases in which readings exceed 160 mg/100 ml.



Stolen credit card

Kentville resident Paul Zinck, 39, pleaded guilty July 30 to theft of a credit card and to using a credit card known to have been obtained unlawfully.

Judge Tufts fined Zinck $50 plus a $7.50 victim surcharge for each of the convictions.

Zinck committed the offenses in Kentville June 9.

License privilege revoked

Wolfville Ridge resident Nathan Malcolm Cox, 22, pleaded guilty July 30 to driving while his privilege of obtaining a driver’s license was revoked, contrary to the Nova Scotia Motor Vehicles Act.

Judge Tufts fined Cox $500 or 30 days in custody on willful default.

Cox committed the offense in Wolfville April 29.
