Probation, fine for breathalyzer

The court has imposed a fine and a term of probation on an Upper Vaughn man for a breathalyzer offense.

In Windsor provincial court Tuesday, July 24, Judge J.A. MacLellan imposed a term of 18 months of probation on Christopher Spencer, 42, for having care and control of a vehicle while his blood-alcohol level exceeded the legal limit. The judge also fined the accused $600, or nine days in custody on willful default.

Probationary conditions include, among others, Spencer taking assessment, counselling or treatment recommended by Corrections officials, and refrain from possessing and/or consuming alcoholic beverages and/or non-medically prescribed drugs.

The court had prohibited Spencer from driving in Canada for two years when he pleaded guilty to the charge June 19. The Nova Scotia Registry of Motor Vehicles will at least match the Canada-wide driving ban.

Spencer committed the offense in Windsor April 30 when police found he had blood/alcohol readings of 140 and 130 milligrams of alcohol per 100 millilitres of blood.

The legal limit is 80 mg/100 ml.

Probation for assault

Judge MacLellan suspended sentencing July 24 on Upper Rawdon resident Francois Pingnatore, 25, for committing assault and imposed a term of one-year probation on him.

Among the probationary conditions are that Pingnatore take counselling recommended by Corrections officials and that he have no contact with the victim.

Pingnature committed the assault in Windsor May 7. He pleaded guilty to the charge June 12.

Break-in nets probation

Judge MacLellan suspended sentencing July 24 on Three Mile Plains resident John Allen Russell, 19, for break, entry and committing the indictable offense of theft and imposed a term of one-year reporting probation on him.

Probationary conditions include that Russell take assessment, counselling or treatment recommended by Corrections officials, live at a specific resident, attend classes or seek employment, and refrain from possessing and/or consuming alcoholic beverages and/or non-medically prescribed drugs.

Russell committed the break-in and theft at a Three Mile Plains address June 21, 2006. He pleaded guilty to the charge April 30.
