Jailed for drug, driving offenses

A Berwick man is off to jail for a drug and a number of driving convictions.

Kaz Henry Cox, 28, pleaded guilty in Kentville provincial court July 5 to possession of cocaine, a Schedule III drug under the Controlled Drug and Substances Act (CDSA).

He had already pleaded guilty May 22 to two counts of driving while disqualified, contrary to the Criminal Code of Canada, and to two counts of failing to attend court as ordered.

As well, the court had found Cox guilty May 15 of, in order to avoid criminal or civil liability, not stopping in a reasonable time while pursued by police and of driving while disqualified.

Judge Tufts sentenced Cox to one month in custody for each of the offenses. The sentences will be served consecutively, except for one of the disqualified driving convictions, which will be concurrent.

The six-month total sentence will be followed by 12 months’ probation.

Cox possessed the cocaine in Kingston January 26, 2006, drove while disqualified in Greenwood December 8, 2005; in Wilmot January 26, 2006. He failed to attend court as ordered in Kentville May 24, 2006 and again June 14, 2006. He failed to stop for police and drove while disqualified in Kingston January 6, 2006.

Cox had been in remand since March.

Possessed ecstasy

Judge Tufts found Clayton Benjamin Fairn, 22, guilty July 5 of possession of methylenedioxyamphetamine (ecstasy), a Schedule III drug under the CDSA.

The judge fined Fairn $500 of eight days in custody on willful default.

Fairn committed the possession in Port Williams December 10.

Probation for assaults, mischief, failing to attend

Judge MacDonald suspended sentencing on Kentville resident Robin Kristie

Millet, 30, May 28 on convictions of assault, assaulting a police officer in

the performance of duties, committing mischief and failing to attend court

as ordered, and imposed a term of three months reporting probation on her.

The probation conditions also include, among others, Millett taking any assessment, counselling or treatment recommended by Corrections officials, and a ban on her possessing and/ or consuming alcoholic beverages.

Millett committed the assault in Kentville Feb. 27, 2006. She assaulted the police officer, and committed the mischief, when she damaged government property, in Kentville the following day.

Millett pleaded guilty to those offenses Aug. 10.

She pleaded guilty to the failure to attend court May 28. She committed that offense in Kentville Oct. 6, 2006.

Fled the accident scene

Stellarton, Pictou County, resident James Keith Rector, 35, pleaded guilty May 24 to having care and control of a motor vehicle while involved in an accident, and leaving the scene in order to avoid civil or criminal liability.

Judge Alan Tufts fined Rector $600 plus a $90 victim surcharge, or 11 days in custody on willful default.

Rector committed the Criminal Code offense in Greenwood Aug. 5, 2006.

Fined for refusal, MVA offense

North Kentville resident Larry Scott Atwell, 27, pleaded guilty May 28 to refusing to give a breath sample for blood-alcohol analysis, under the Criminal Code, and to being a new driver, having alcohol in his blood, contrary to the Motor Vehicles Act.

Judge MacDonald fined Atwell $650 plus a $97.50 victim surcharge, or 12 days in custody on willful default, for the refusal.

MacDonald also prohibited Atwell from driving in Canada fro a year, a term the Registry of Motor Vehicles will at least match.

For the MVA offense, MacDonald fined Atwell $250 plus a $37.50 victim surcharge and $100 costs.

Atwell committed the offenses in Kentville Feb. 24.

Possessed stolen property

Bridgetown resident Kyle Joseph Keddy, 22, pleaded guilty May 28 to possessing property valued at less than $5,000 and known to have been obtained unlawfully.

Judge MacDonald fined Keddy $250 plus a $37.50 victim surcharge, or four days in custody on willful default, for the offense.

Keddy committed the offense in Coldbrook Dec. 22, 2006.

Expensive drive

Wilmot resident Cullen Joseph McDonald, 28, pleaded guilty May 28 to driving without proof of financial responsibility and driving while his license was suspended, both contrary to the Nova Scotia Motor Vehicles Act.

Judge MacDonald fined MacDonald $1,000 plus a $120 victim surcharge for the first offense and $500 plus a $75 victim surcharge for the second.

The accused committed the offenses in Cambridge April 3.

Drove while privilege revoked

Aylesford resident Troy Michael Higgins, 29, pleaded guilty May 28 to driving while disqualified because his privilege of obtaining a driver's license was revoked, contrary to the Motor Vehicles Act.

Higgins committed the offense in Aylesford April 2.

Pleaded guilty to thefts, breach

Scotch Village, Hants County, resident Michael Roy Atkinson, 31, pleaded guilty May 29 to break and entry at Nova Scotia power Inc in Kentville and committing an indictable offense. He had pleaded guilty May 7 to two counts of break and entry and theft at ACO Coop, New Minas, and failing to comply with a probation order.

Judge MacDonald ordered Atkinson remanded and scheduled him to return to court July 4, pending a pre-sentence report, for sentencing.

Atkinson will also elect and plea on a charge of failing to comply with an undertaking.

Atkinson committed the Nova Scotia power break-in Feb. 9 and the ACCA Co-op ones Nov. 13 and Feb. 26, when he committed the probation breach.

In other court matters

Canning resident Amanda Jean Pudsey, 28, pleaded guilty May 28 to failing to register a dog, contrary to the Kings County animal control by-law.

Judge MacDonald fined Pudsey $100 plus a $15 victim surcharge and $100 costs.

Pudsey committed the infraction in Canning May 2.
