Drug possession, evaded police

Amanda Lee Mahaney, 34, of Kentville, has been fined for unlawfully possessing marijuana and cocaine. She was also handed a suspended sentence with probation for evading police.

Mahaney pleaded not guilty to the charges of evading police and unlawfully possessing cocaine for the purpose of trafficking on April 2, 2013. She pleaded not guilty to the marijuana possession charge on July 15. The matters were adjourned for trial.

Mahaney was found guilty to failing to stop her vehicle as soon as was reasonable in the circumstances in order to evade police on Jan. 14, then was found not guilty on the charge of possessing cocaine for the purpose of trafficking on Jan. 30. However, she was found guilty of the lesser, included offence of possession and changed her plea to guilty on the charge of possessing not in excess of 30 grams of marijuana.

During the March 27 sentencing, Judge Claudine MacDonald fined Mahaney $115 for possessing marijuana; $345 for possessing cocaine; and handed her a suspended sentence with one year of probation and a six-month driving prohibition for evading police.

Mahaney committed the offences of evading police and unlawfully possessing cocaine in Coldbrook on Oct. 3, 2012 and the offence of unlawfully possessing marijuana in Kentville on Oct. 17, 2012.

 

Suspended sentence, probation for mischief

Mary Tabatha Garvock, 45, of Berwick, has been handed a suspended sentence with probation for committing mischief by willfully damaging a window.

Garvock pleaded not guilty to the mischief charge and to a charge of stealing prints valued at less that $5,000 on Nov. 7, 2011. Garvock was present, in custody, in Kentville provincial court on March 25 and changed her plea to guilty to the mischief charge.

Judge Claudine MacDonald handed Garvock a suspended sentence with 12 months of probation and ordered her to pay $270.25 in restitution through the court to the Falcourt Inn in Nictaux. The charge of stealing prints was adjourned to April 7 for disposition.

Garvock committed the offence in Nictaux on Sept. 8, 2010.

 

Suspended, conditional sentences for drug, probation charges

Franklin Dale McKay, 25, of New Minas, was handed a suspended sentence with probation for unlawfully possessing cocaine and marijuana and a conditional sentence order with daily curfew for failing to comply with probation.

McKay pleaded guilty to the charges on Feb. 10. The matters were adjourned to March 26 for sentencing. Judge Claudine MacDonald handed McKay a 12-month suspended sentence with probation for the two drug possession charges.

McKay was handed a 60-day conditional sentence with daily curfew from 10 p.m. to 6 a.m.

A charge of possessing a weapon dangerous to the public peace was withdrawn. However, the court granted a forfeiture order for a machete.

McKay committed the offences in New Minas on Oct. 29, 2013.

 

Conditional discharge, probation for assault using weapon, undertaking offence

Hassen Ali Choudhary, 20, of Wolfville, has been handed a conditional discharge with probation for assault using a weapon, in this case a laundry basket, and failing to comply with his undertaking.

Choudhary pleaded guilty to the charges Feb. 10. The matters were adjourned to March 27 for sentencing. Judge Claudine MacDonald handed Choudhary a conditional discharge with 12 months of probation on both charges.

Choudhary committed the offence of assault in Wolfville on Dec. 5 and failed to comply with his undertaking in New Minas on Jan. 6, 2014.

 

Conditional discharge, probation for assault

Wallace Anthony Lightle, 42, of Black River, has been handed a conditional discharge with probation for the included offence of assault.

Lightle pleaded not guilty to the original charge of assault causing bodily harm on Jan. 13. The matter was adjourned to March 27 for trial but Lightle changed his plea to guilty to the lesser, included offence of assault with the consent of the Crown.

Judge Claudine MacDonald handed Lightle a conditional discharge with nine months of probation.

Lightle committed the offence in Black River on Oct. 13, 2013.

 

Suspended sentence

Phillip Wayne Clayton, 40, of Berwick, received a suspended sentence and 12 months of probation during a March 31 court appearance in Kentville.

Clayton was found guilty of assault at a trial held Feb. 4. The charges were laid June 18, 2013 in Kingston.

Clayton was also ordered to complete 25 hours of community service work in nine months as part of his sentence.
