CSO suspended

A Welton’s Corner man is in jail after admitting to breaching a conditional sentence order (CSO).

John Leroy Jones admitted to the breach in Kentville provincial court Wednesday, Dec. 17. Judge Alan Tufts suspended Jones’s CSO for 120 days.

Jones breached the CSO in Kentville Nov. 17 when he consumed drugs, as prohibited by his conditions.

The court had imposed the two-years-less-a-day CSO May 7 for a conviction of possession of cocaine, a Schedule I drug under the Controlled Drugs and Substances Act (CDSA), for the purpose of trafficking.

The original offense took place at Welton’s Corner Feb. 22, 2006.

Fine, probation for care and control

Somerset resident James Robert Blair, 60, pleaded guilty Monday, Dec. 15 to having care and control of a vehicle while his blood-alcohol level exceeded the legal limit.

Judge Tufts fined Blair $1,250 plus a $187.50 victim surcharge, or 22 days in custody on willful default, and imposed a term of one-year reporting probation on him.

Probationary conditions include Blair taking any recommended assessment, counselling or treatment, and refraining from possessing or consuming alcoholic beverages or non-medically prescribed drugs.

The judge also prohibited Blair from driving in Canada for a year. The Nova Scotia Registry of Motor Vehicles will ban Blair from driving in the province for at least a year.

Blair committed the offense in Cambridge Oct. 5, 2008 when police found he had blood-alcohol readings of 230 and 230 milligrams of alcohol per 100 millilitres of blood.

The legal limit is 80 mg/100 ml, with the Criminal Code of Canada permitting heavier penalties for those breathalyzer convictions in which readings exceed 160 mg/100 ml.

MVA fines

Waterville resident Donald Kenneth Croft, 33, pleaded guilty Dec. 15 to driving while his privilege of obtaining a license was revoked, driving without the required liability insurance coverage, and driving an unregistered vehicle, all contrary to the Nova Scotia Motor Vehicles Act (MVA).

Judge Tufts fined Croft $1,000 each for the revoked privilege and insurance offenses, and $100 for the unregistered vehicle.

Croft committed the offenses in New Minas Oct. 17, 2008.

Fine, suspension for driving

Canning resident Zachary Robert Long, 18, pleaded guilty Dec. 15 to failing to drive in a careful and prudent manner and to failing to stop immediately at the scene of a motor accident in which he was involved, both contrary to the MVA.

Judge Tufts fined Long $175 for each of the offenses and suspended his license from Dec. 15, 2008 to Jan. 15, 2009.

Breached probation

Waterville resident Matthew James Pelton, 26, pleaded guilty Dec. 15 to failing to comply with a probation order.

Judge Tufts fined Pelton $200 or three days in custody on willful default.

Pelton committed the breach in Kingston Aug. 31, 2008.

Fine for theft

Kentville resident Robert Dale Hiltz, 37, pleaded guilty Dec. 15 to theft of property valued at less than $5,000. Judge Tufts fined Hiltz $50.

Hiltz committed the offense at a Kentville farm market Nov. 6.

Drove while privilege revoked

A representative for Aylesford resident Kevin William Muise, 23, pleaded guilty on his behalf Dec. 15 to driving while his privilege of obtaining a license was revoked, contrary to the MVA. Judge Tufts fined Muise $1,000.

Muise committed the offense in Aylesford Sept. 30, 2008.

Granted conditional discharge

Judge Tufts granted a conditional discharge Dec. 15 to Kingston resident Nicole Marie Martha Poirier, 41, on a charge of assault causing bodily harm. The discharge is pending 12 months’ reporting probation, conditions of which include that Poirier take any recommended assessment, counselling or treatment, and refrain from possessing or consuming alcoholic beverages or non-medically prescribed drugs.

The charge was in connection with an April 21 incident in Kingston. Poirier pleaded guilty to the charge Dec. 15. --

Judge Tufts granted north Kentville resident Jessica Toni Lea Davidson, 20, a conditional discharge Dec. 15 on a charge of assault.

The discharge is pending four months of reporting probation, a condition of which is that Davidson take any recommended assessment, counselling or treatment.

The charge resulted from an incident at Grand-Pre Sept. 24. Davidson pleaded guilty to the charge Dec. 15.

Convicted automatically

Judge Tufts convicted automatically North Preston resident Cory Daniel Fraser, 28, Dec. 15 of driving while his privilege of obtaining a license was suspended, contrary to the MVA, and fined him $1,000.

Police laid the charge at Exit 8 on Highway 101 Oct. 9. --

Dec. 15, Judge Tufts convicted automatically Steven James Giordani, 39, of driving while his privilege of obtaining a license was revoked, contrary to the MVA, and fined him $1,000.

Police laid the charge near Exit 16 on Highway 101 Oct. 31, 2008.

In other court matters

Wolfville resident Hunter Robert Johnson, 20, pleaded guilty Dec. 15 to illegal possession of liquor, contrary to the Nova Scotia Liquor Control Act (LCA), and requested a remission of penalty.

Granting the remission, Judge Tufts fined Johnson $100. The fine could have been $300 plus a $45 victim surcharge and $107 in costs.

Johnson committed the offense in Wolfville Sept. 6, 2008.
