Jail time, probation for accessing child porn

The court has sentenced a Windsor man to jail time and probation for accessing child pornography.

Judge Alan Tufts sentenced Terrance Andrew Fogarty, 26, in Windsor provincial court Monday, Nov. 24 to 14 days in custody, to be served intermittently, for the offense.

The sentence will be followed by three years’ probation, conditions of which include that Fogarty take any recommended assessment, counselling or treatment and not be in the company of persons under the age of 16 without the presence of a person 21 years of age or older.

Fogarty must also provide a DNA sample to be kept on record by Corrections officials, and be on the Sexual Offender Register for 10 years.

Fogarty committed the offense in Windsor between Feb. 5, 2007 and Feb. 5, 2008. He pleaded guilty to the charge Sept. 30.

Deemed served

Lower Burlington resident Leslie Joseph Arsenault, 21, pleaded guilty Nov. 24 to failing to comply with a probation order.

Judge Tufts sentenced Arsenault to one day in custody deemed served by his court appearance.

Arsenault committed the breach in Burlington Feb. 7 when he associated with a person who had a criminal, youth or drug record.

Short sentence

Lakelands resident Gregory Lake-Crossley, 40, pleaded guilty Friday, Nov. 21 to a charge of assault.

Judge Claudine MacDonald sentenced Lake-Crossley to one day deemed served by his court appearance.

Lake-Crossley committed the assault in Windsor July 24, 2005.

Granted conditional discharge

Judge Tufts granted a conditional discharge Nov. 24 to Windsor resident Clyde Strowbridge, 49, on a charge of failing to comply with an undertaking condition not to communicate with a specific person. The discharge is pending four months of reporting probation and a $500 charitable donation to Avon View High School.

The charge stemmed from an incident in Windsor June 30. Strowbridge pleaded guilty to the charge Sept. 30.
