The court has sentenced a Black River man to federal time for marijuana-related offenses.

Judge Alan Tufts sentenced Brian Merrill Levy, 61, in Kentville provincial court Wednesday, April 16 to a total of two years in federal custody for unlawfully producing cannabis marijuana, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA); possession of more than three kilograms of cannabis marijuana for the purpose of trafficking; possession of unlawfully obtained property valued at more than $5,000; two counts of possession of loaded restricted automatic handguns for which he had no authorization, license or registration; possession of two revolver handguns for which he had no authorization, license or registration; possession of two military rifles for which he had no authorization, license or registration; and improper storage of firearms.

The sentence for the production was two years consecutive, minus 16 months’ credit for remand; the possession was the same concurrent, while the other sentences were 16 months each, concurrent to each other but consecutive to others, for a total of 24 months.

Tufts ordered Levy to provide a DNA sample to Corrections officials and forfeited materials involved in the crimes. He also imposed a firearms ban on the accused.

Levy committed the offense in Black River Aug. 24, 2007. The court withdrew similar charges against a co-accused.
