Not guilty pleas entered for sex, firearm charges

A Falmouth man facing several sex and firearm-related charges has pled not guilty and will be back in court in February and March to stand trial.

Joseph Morton Flynn, 30, is charged with assault; uttering a threat to burn down a person’s house and two counts of failing to comply with a recognizance. These charges stem from incidents alleged to have occurred in St. Croix on Sept. 28.

Flynn is also charged with sexual assault; assault, using a rifle in committing a sexual assault, uttering a death threat, pointing a firearm at an individual and possessing a weapon, a rifle, for the purpose of committing an offence. This set of charges relate to incidents that allegedly occurred in St. Croix on May 17, 2012.

Flynn is charged with touching a person under the age of 16 with his penis for a sexual purpose, sexual assault and uttering a death threat. These charges relate to incidents that allegedly happened in St. Croix on Sept. 23, 2004.

Flynn pled not guilty to all charges and elected provincial court on Nov. 26. Flynn will stand trial on the set of 2004 charges on Feb. 28, 2014. The trial is expected to take half a day. He will stand trial on the remaining charges on March 7, 2014. This trial is expected to take a full day.

The court has imposed publication bans on the names of the alleged victims and any information leading to their identities.

 

Upper Rawdon man to stand trial on sexual assault charges

An Upper Rawdon man facing several sexual assault charges will stand trial in February. Glenn Garry Nelson, 53, is facing four counts of sexual assault. He pled not guilty to the charges on April 23, 2013 and the matters were adjourned for trial. The accused was present in Windsor provincial court on Nov. 25, when an application under Section 276.2 (1) of the Criminal Code was granted to exclude the public. The matters were adjourned to Feb. 3, 2014 for trial.

The charges stem from incidents alleged to have occurred in Rawdon on Dec. 24, 25, 26 and 27, 2012. The court has imposed a publication ban to protect the identity of the alleged victim.

 

Hantsport man to stand trial on sex-related charges, assault charge

Trevor Murray Clowry, 31, of Hantsport, will stand trial in February 2014 on several sex-related charges and an assault charge.

Clowry pled not guilty on July 26, 2013 to a charge of assault, two counts of engaging in an act of anal intercourse, engaging in an act of anal intercourse using a mechanical device and committing a sexual assault with his fist. The matters were adjourned for trial.

The accused was not present in Windsor provincial court on Nov. 25, having previously filed a designation of counsel with the court. Defence attorney Chris Manning is representing him. The court granted a defence request for an adjournment on Nov. 25. The Crown was not opposed. The matters were adjourned to Jan. 10, 2014 for the court to hear an application under Section 276 of the Criminal Code, which relates to evidence of a complainant’s sexual activity. The matters have been adjourned to Feb. 21, 2014 for trial, which is expected to take a full day.

The charges stem from incidents alleged to have occurred in Hantsport between Jan. 1 and 30, 2012, on June 15, 2013 and between June 16 and 27, 2013. A publication ban protects the identity of the alleged victim.

 

Probation for sexual assault

Patrick Edward Stewart Brown, 19, of Newport Corner, appeared in Windsor provincial court Nov. 29 for sentencing on a June 5, 2012 charge of sexual assault. He entered a guilty plea to the charge, laid in Windsor, and was handed two years probation by the court. He was also ordered to submit a DNA sample and his name will be listed on the sexual offenders registry for a 10-year period.

 

Probation, suspended sentence for uttering threats

Tammy Foster, 37, of Three Mile Plains, pleaded guilty to uttering threats in Three Mile Plains on June 21, 2012. During a Nov. 29 court appearance in Windsor, Foster was handed a suspended sentence and 12 months of probation. She was also ordered by the court to pay a $100 victim service fee.

 

Probation offence

Jeremy Lawrence Long, 24, of Windsor, has been sentenced to time deemed served for failing to comply with probation.

Long pled guilty to the charge on Dec. 10, 2013 and was sentenced to one day in custody deemed served.

Long committed the offence in Windsor between May 13 and Aug. 22, 2013. 

 

Breathalyzer offences

Ryan Herman Patrick Hatchard, 31, of Falmouth, has been fined for having the care or control of a motor vehicle while his blood alcohol level exceeded the legal limit.

Hatchard pled guilty to the charge on Dec. 10, 2013.

Judge Claudine MacDonald fined Hatchard a total of $1,490 and imposed a one-year driving prohibition against him.

Hatchard committed the offence in Mount Denson on Oct. 27, 2013. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Hatchard gave breathalyzer readings of 280 and 290.

Wade Slaunwhite, 48, of Lower Sackville, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Slaunwhite pled guilty to the charge on Nov. 25, 2013. Judge Claudine MacDonald fined Slaunwhite a total of $1,100 and imposed a one-year driving prohibition order with an ignition interlock device clause against him.

Slaunwhite committed the offence in Mount Uniacke on July 13, 2013. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Slaunwhite gave breathalyzer readings of 210 and 230.

Alexander Mitchell Dill, 21, of Sweets Corner, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Dill pled guilty to the charge on Nov. 26, 2013. Judge Claudine MacDonald fined Dill a total of $1,380 and imposed a one-year driving prohibition against him.

Dill committed the offence in Windsor on Sept. 20, 2013. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Dill gave breathalyzer readings of 190 and 180.

Curtis Randall Grant Hill, 48, of Scotch Village, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Hill pled guilty to the charge on Nov. 26, 2013. Judge Claudine MacDonald fined Hill a total of $1,490 and imposed a one-year driving prohibition against him.

Hill committed the offence in MacKay Section on Sept. 17, 2013. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Hill gave breathalyzer readings of 220 and 220.

 

 

Conditional discharge granted

Caryn Grace Breed, 55, received a conditional discharge and six months probation Nov. 1 in Windsor provincial court.

The Greenhill, Hants County, woman pleaded guilty to committing mischief by interfering with the lawful use and enjoyment of another person’s property during an Oct. 28 court appearance. The offence occurred Feb. 23, 2013 in Hillsvale.
